These Regulations may be amended from time to time in accordance with the procedures specified in Section 8-25 of the Connecticut General Statutes, and amendments thereto.
A. 
If any section, paragraph, sentence, clause or phrase of these Regulations shall for any reason be held to be invalid or unconstitutional by a decree or decision of any court or competent jurisdiction, such decree or decision shall not affect or impair the validity of any other section or remaining portion of these Regulations.
B. 
If any section, paragraph, sentence, clause or phrase or these Regulations shall for any reason be held to be invalid or unconstitutional, as applied to a particular subdivision or subdivision application, by decree or decision of a court or competent jurisdiction, such decree or decision shall be limited to the particular subdivision or subdivision application and the general applicability of these Regulations to other subdivisions and subdivision applications shall not be affected.
These Regulations and any amendments hereto shall be in full force and effect from the date of adoption by the Commission or from a date subsequent to adoption that the Commission may establish.
APPENDIX: NOTES ON MAPS AND PLANS
A.
General: Maps and plans will contain notes constituting references and restrictions. When applicable to a particular subdivision, the wording hereinafter specified shall be used for notes except as otherwise approved by the Commission.
B.
Water supply, when to be provided by a public utility company:
"Lots on this map are approved on condition that each lot be provided with public water supply. No structures on the lots shall be occupied until such public water supply is available."
C.
On-site utilities:
"Lots on this map are approved based on the provision of individual on-site sewage disposal (and/or water supply) facilities. The location, design and construction of each facility is subject to he approval of the Town of Old Saybrook or its authorized agent in accordance with applicable law prior to issuance of any building permit and prior to occupancy of any building or structure."
D.
Construction: (to be placed on the Construction Plans)
"Construction of all required improvements shall be carried out in accordance with supervision, inspection and other procedures specified in a document entitled Design and Construction Specifications of the Town of Old Saybrook, Connecticut."
E.
Private residential streets (show cross section of each street on the subdivision plan):
"The street identified hereon as "Private Residential Street" is a private street, privately owned and privately maintained, and is not offered to, accepted by or maintained by the Town of Old Saybrook. Owners of abutting lots to which sole access is provided by such private street have the responsibility, individually or in combination with other owners, to maintain such private street to no less than the minimum standards shown hereon".
F.
Turnaround easements, for temporary dead-end streets:
"Easements for temporary turnaround and general highway purposes, which easement shall automatically terminate upon acceptance by the Town of Old Saybrook or any extension of the street".
G.
Construction easements for streets to be offered for acceptance by the Town:
"A temporary easement, to the owner of each street on this map, for grading of slopes, shall exist over all land within twenty-five feet of the right-of-way lone of such streets, which easement shall expire one year after the date of acceptance of the street by the Town of Old Saybrook."
H.
Construction easements for streets not to be offered for acceptance by the Town:
"A temporary easement, to the owner of each street on this map, for grading of slopes, shall exist over all land within twenty-five feet of the right-of-way line of such streets, which easement shall expire one year after the date of the release of the subdivision completion bond."
I.
Sight easements, pertaining to areas delineated over lots at street corners:
"The sight easements shown hereon establish the perpetual right of the owner of the abutting street or highway, or his authorized agents, to clear, regrade and maintain the area within these easements at such elevation of 3.5 feet above the pavement edge and an object one foot above the pavement edge."
J.
Channel, building and encroachment lines:
"Within the area bounded by the channel, building or encroachment lines on this map, no building or other structure shall be located or constructed and there shall be no filling or excavation or dumping of materials."
K.
Erosion and sediment control:
"Construction on lots shown on this map is subject to a Soil Erosion and Sediment Control Plan certified by ___________."
L.
Underground utility lines:
"Within this subdivision, all electric, telephone and cable television wires shall be located underground unless otherwise specifically authorized by the Old Saybrook Planning Commission to be above ground."
