If an elected or appointed officer or employee of the County government or an officer or employee of the County Board of Education not covered under the provisions of §§ 12-304 and 12-306 or §§ 12-401 through 12-406 of the State Government Article of the Annotated Code of Maryland acts within the scope of official duties or employment and without malice, the County may indemnify the officer or employee for any judgment, penalty, fine, settlement and reasonable fees and expenses incurred in connection with any proceeding in which the officer or employee is made a party by reason of service as an officer or employee.
