A.
Sanitation. The premises and structure shall be maintained
in a clean, safe and sanitary condition free from any accumulation of rubbish
or garbage. Responsibility for sanitation shall be as follows:
(1)
Tenant's responsibility. The tenant shall be responsible
for keeping that part of the structure or premises which the tenant occupies,
controls or uses in a clean and sanitary condition.
(2)
Multiple occupancy structures. Each property owner of
a structure containing two or more housing units shall maintain, in a clean
and sanitary condition, the common areas of the structure and premises.
B.
Rubbish and garbage. The tenant shall be responsible
for the temporary storage and disposal of rubbish and garbage in a clean and
sanitary manner as may be required by applicable laws or ordinances.
C.
Insect and rodent control. The premises and structure
shall be free from infestation of insects, rodents, vermin or other pests.
Where infestation is found, the area shall be promptly exterminated by processes
which are not injurious to human health. If the Code Official determines there
are continuing or repeated incidents of infestation, the Code Official may
require structural alterations or repairs.
D.
Responsibility for extermination.
(1)
Before renting. The property owner shall be responsible
for extermination within the structure and on the premises, if necessary,
before renting or leasing the housing unit.
(2)
Single-occupancy structure. The tenant of a structure
containing a single housing unit shall be responsible for extermination in
the structure or on the premises.
(3)
Multiple-occupancy structure. The property owner or operator
of a structure containing two or more housing units shall be responsible for
extermination in the structure or on the premises, except where an infestation
within a housing unit is caused by a failure of the tenant to take reasonable
action to prevent the infestation.
A.
Maintenance. The structure and its equipment and facilities
shall be maintained in good repair and in a clean, safe, sound and sanitary
condition so as not to pose a threat to the health, safety or welfare of the
occupants.
B.
Structural members. Supporting structural members shall
be kept structurally sound, free of deterioration and maintained capable of
safely carrying the imposed loads.
A.
Exterior surfaces. Each foundation, exterior wall, roof,
window, door and all other exterior surfaces shall be structurally sound and
shall be maintained in good repair and free from open cracks, breaks, holes
and any other defects or conditions which might admit rain, dampness or wind
to the interior portions of the structure or allow entry by rodents and other
pests.
B.
Exterior surface materials. All exterior surface materials
shall be maintained weatherproof and shall receive a periodic application
of paint or other protective surface-coating material when required for protection
against decay and corrosion.
C.
Exterior accessories. All exterior accessories, including
decorative features, cornices, trim, signs, canopies, awnings, porches, stairways,
fire escapes, balconies, standpipes, exhaust ducts, chimneys, cooling towers,
smoke stacks and similar features, extensions and appurtenances shall be maintained
in a safe and sound condition and in good repair with proper anchorage and
surface coating.
D.
Windows and doors.
(1)
Weathertight. Each window and exterior door shall be
fitted reasonably in its frame and be weathertight.
(2)
Openable windows. Each window used for ventilation or
emergency escape shall be capable of being easily opened from the inside and
shall be held in position by window hardware.
(3)
Insect screens. During the period from April 1 to December
1, every door and window or other outside opening used for ventilation purposes
shall be supplied with tight-fitting insect screens.
(4)
Door hardware. All doors entering housing units shall
be fitted with locks and hardware maintained in good repair and capable of
tightly securing the door.
A.
Owner-supplied fixtures and equipment.
(1)
The tenant shall be responsible for keeping owner-supplied
equipment and fixtures clean and sanitary and for the exercise of reasonable
care in their proper use and operation.
(2)
The property owner shall be responsible for maintaining
the equipment and fixtures in good and proper operating condition.
B.
Fixtures and equipment furnished by tenant. The tenant
shall be responsible for the maintenance of fixtures and equipment furnished
by the tenant.
