Fire prevention — See Ch. 156.
No person shall kindle a fire upon the land of another without permission from the owner, his agent or his caretaker.
No person shall kindle or cause to be burned any material in an open fire on public or private property without first obtaining a permit from the Fire Department, except as otherwise provided in this chapter.
The following regulations shall govern the issuance of a permit under this chapter:
A. 
The fire chief or his deputy shall, prior to the issuance of a permit, make a determination that the burning contemplated will not endanger the public safety.
B. 
There shall be no fire before dawn or after dusk, and all permittees shall extinguish their fires prior to dusk.
C. 
All applications for permits must be submitted 24 hours prior to the issuance of the permit.
D. 
Cooking fires, other than charcoal, in metal stoves and masonry fireplaces require the issuance of a permit and shall be extinguished prior to dusk by the person responsible.
E. 
No permit shall be issued for the burning of materials which would create a violation of applicable air pollution control regulations.
Open burning of subdivision community rubbish is prohibited with the exception of the burning of vegetation, trash or building materials resulting from construction and building operations, provided that such material cannot be readily reduced in size for easy removal and provided that the person performing the burning operations obtains a permit therefor from the Fire Department. Permitted burning shall be performed in a manner, during the hours, at such time of the year, and pursuant to favorable weather conditions as prescribed by the Fire Department.
The issuance of a permit under this chapter shall in no way relieve the person responsible for a fire of any liability for damages caused by such fire.

Any person violating the provisions of this chapter shall, for each offense, be punished as provided in § 1-12 of the City Code.
