City of Nashua, NH Article III Stop and Yield Intersections

§ 320-4 Stop intersections.

A. Preferential right-of-way at an intersection may be indicated by stop signs.

B. Except when directed to proceed by a police officer or traffic-control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall stop before entering the crosswalk on the near side of the intersection or, in the event that there is no crosswalk, shall stop at a clearly marked stop line, but if none, then at a point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection.

C. All stop signs which have been erected at the time of the passage of this chapter are hereby approved.

D. The following intersections are hereby designated as stop or through streets, and authority is hereby granted for the erection of a stop sign at the corner so designated in accordance with the tenor of this chapter:

§ 320-5 Yield intersections.

A. Preferential right-of-way at an intersection may be indicated by yield signs.

B. The driver of a vehicle approaching a yield sign, if required for safety to stop, shall stop before entering the crosswalk on the near side of the intersection or, in the event that there is no crosswalk, at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway.

§ 320-6 Fire station signals. [1]

The following locations shall have traffic signals installed and maintained in accordance with the standards established by the United States Department of Transportation's Manual on Uniform Traffic Control Devices of 1971, or as may be amended or revised, and the State Department of Public Works and Highways' Traffic Division Standards on Fire Station Signals. Such signals shall be designed so as to indicate a flashing amber indication in each approaching direction during normal operation and a steady red indication at such times as deemed appropriate by the City Fire Department.

§ 320-8 City-maintained flashing beacons.

§ 320-9 Other signs in street rights-of-way.

The following procedures shall be followed for the installation of all signs in City street rights-of-way which are requested by any nongovernmental agencies, organizations or private enterprises:

A. Requests for the installation of signs shall be made, in writing, to the Board of Aldermen, and shall be referred to the appropriate aldermanic committee. Requests shall include written and pictorial descriptions of the proposed signs, the locations where they are proposed to be erected, and their purpose or intended function.

B. Upon receipt of such request, the appropriate aldermanic committee shall invite the person making the request to attend its committee meeting to discuss the proposal. The Board shall also refer the request to the Public Works Division for review and comment on the locations of the proposed signs.

C. Once the sign locations have been reviewed and the person requesting the signs has been consulted, the appropriate aldermanic committee will forward their recommendation to the full Board of Aldermen to grant, grant with modifications or deny the request. In reviewing a sign request, the Board shall take into consideration whether the applicant is a for-profit or nonprofit organization, the size, shape and information displayed on the sign, its location, and the character of the areas in which the signs will be located. Permissible signs shall only include those intended for directional or informational purposes. In no instance shall advertising or proprietary names be used on such signs. Notice of final Board action on a request shall be forwarded to the person making the request, the City Clerk and the Public Works Division.

D. If the requested signs are approved, the person making the request shall consult with the Public Works Division as to suitable methods of installation. The Public Works Division shall inspect the signs once they are installed to ensure their proper location and method of installation.

E. The Public Works Division and the City Clerk shall maintain a file of all approved sign requests.

F. Any request which is granted may be revoked by a vote of the Board of Aldermen, which shall give 30 days' written notice to the person who requested the signs. If that party does not remove the signs within the specified time period, the Board shall authorize their removal by the Public Works Division.

G. Any sign installed in a City street right-of-way according to the procedures outlined in this chapter shall not be subject to the provisions of the Zoning Ordinance.[1]

H. All existing signs in any public way within the City which fall under the conditions of this section shall be removed by the sign owner within one year after passage of this chapter, unless a sign permit is obtained in accordance with this section. Failure to comply with this subsection shall constitute sufficient grounds for the Board of Aldermen to order removal of such nonconforming signs by the Public Works Division as may remain in public ways one year after passage of this chapter.

I. Any sign installed in a City street right-of-way without having obtained the approvals required in this section may be removed by the Public Works Division at the direction of the Board of Aldermen.

§ 320-10 Traffic calming.

A. Purpose and intent. Recognizing that the regulation of speed and volume of traffic on the surface streets of Nashua is essential to the maintenance of the public safety, and further recognizing that such speed may be controlled in part by the design of roadways, it is the purpose and intent of this section to extend authority to utilize a common body of street engineering techniques known collectively as "traffic calming." Such techniques are to be used in the design, modification, and maintenance of the City's roadways for the purpose of promoting travel at rates of speed which are at or below the speed limits on those roadways. It is not the intent of this section to promote techniques which cause continual stopping and starting of traffic on those roadways.

B. Adoption of authority and standards. Pursuant to the purpose of this section, the City of Nashua hereby adopts traffic calming as a technique for local roadway design and adopts the standards for traffic-calming measures as set forth in Traffic Calming: State of the Practice, published August 1999, by the Institute of Transportation Engineers and the Federal Highway Administration, and referenced as FHWA-RD-99-135. Any successor to this publication is hereby incorporated by reference. This section shall not be construed to disallow any other traffic-calming measure not described in the aforementioned publication, provided that such measure is adopted by the process provided below.

C. Procedure for adoption of traffic-calming measures. The adoption of specific traffic-calming measures on particular streets shall be by ordinance. The Board of Aldermen shall refer each such proposed ordinance to the Board of Public Works for its advice, and the Board of Public Works shall issue a recommendation to the Board of Aldermen within 30 days of receipt of such referral.
