The following terms, when used in this article, shall have the following meanings, unless a different meaning clearly appears from the context:
PARKING
The stopping of a vehicle upon a restricted street otherwise than in obedience to traffic regulations or traffic signs or signals for a period longer than reasonably necessary to load or unload passengers or freight.
PARKING LOT
Any municipally controlled property or structure designated for the parking of motor vehicles, whether for a fee or at no charge.
PARKING METER
That mechanism having a fee-receiving and a fee-actuating mechanism all enclosed and mounted on top of a post, including electrical and/or mechanical devices designed to indicate entrance or expiration time to a parking space. Any use of the term "parking meter" or "metered" in this article can also mean a parking pay station as the mechanism to pay for the use of a parking space for a period of time.

PARKING METER ZONE
Any restricted street, parking garage or parking lot upon which parking meters are installed and in operation.
RESTRICTED STREET
That part of any public street, avenue, road, boulevard, highway or other public place established for the use of vehicles within the City and with parking restricted to a limited period only.
VEHICLE
Any device in, upon or by which any person or property may be or is transported upon a highway.
A. 
The purpose of this article is to assure the general public a free use of the City's streets by regulating and enforcing the privilege of parking and thereby hastening the departure of parked vehicles on restricted streets and to aid parking enforcement and the police in enforcing regulations governing the parking of vehicles.

B. 
Parking a vehicle within a parking zone for a period of time not longer than the established time limit shall be permitted only upon the payment of a fee, as designated on the parking meter.

The revenue derived from the use of meters shall be expended to finance the purchase, maintenance and policing of such meters, or to maintain and improve streets and highways, or to acquire, construct, improve, maintain and manage public parking areas and public transportation systems, or for any combination of the foregoing purposes, but for no purpose not expressly authorized in this section.

A. 
Starting with the FY2013 budget, an amount equivalent to the sum of any parking revenue received over and above $728,000 shall be appropriated annually in the budget to be used for the purpose of improving the Downtown - 1 zoning district. Uses of these funds shall include, but not be limited to, improvements to infrastructure, beautification, and marketing and promotion. The time frame for the calculation of the amount shall be January 1 to December 31. Beginning in 2013, if at the end of the year the parking revenue shall fall below $1,128,000 or exceed $1,378,000, the Board of Aldermen shall review the amount of $728,000 above, and adjust that amount as necessary.
B. 
Notwithstanding Subsection A above, for the calendar year of 2021, and fiscal year budget 2022, an amount equivalent to the sum of parking revenue of $100,000 shall be appropriated in the FY 2022 budget for the purpose of improving the Downtown-1 Zoning District. In calendar year 2022, and fiscal budget year 2023, the funding shall resume as stated in Subsection A, above.

A. 
There shall be a Downtown Improvements Committee consisting of 11 members and two alternates, who shall advise the Mayor as to how to appropriate the funding for downtown improvements. The final determination of what purpose or purposes the funding shall be used for shall be determined by the Mayor and the Board of Aldermen through the regular budget process. The Committee shall also provide recommendations on matters impacting downtown.

B. 
The members of the Committee appointed by the Mayor shall serve for three-year terms. The initial appointments shall be made for terms of one, two, and three years so that the members' terms will be staggered. The members of the Committee shall be as follows:
(1) 
The Economic Development Director, whose term shall be commensurate with his or her employment with the City.
(2) 
The Mayor shall appoint and the Board of Aldermen shall confirm four members who shall be City residents, and at least one of those four residents shall live within the Downtown - 1 zoning district.
(3) 
The Mayor shall appoint and the Board of Aldermen shall confirm four members who shall be any of the following: consumers of businesses or nonprofits located within the Downtown -1 zoning district; business owners or employees of businesses located within the Downtown - 1 zoning district; nonprofit employees or volunteers doing work within the Downtown - 1 zoning district; owners of property located within the Downtown - 1 zoning district; or residents that live within the Downtown - 1 zoning district.
(4) 
The Mayor shall appoint and the Board of Aldermen shall confirm two additional members who are either a City resident who lives within the Downtown - 1 zoning district or a business owner of a business located within the Downtown - 1 zoning district.

(5) 
The Mayor shall appoint and the Board of Aldermen shall confirm two alternates to the Committee, one who meets the requirements of Subsection B(2) and one who meets the requirements of Subsection B(3).

(6) 
The Committee shall also have a nonvoting Aldermanic liaison and alternate who shall be appointed by the President of the Board of Aldermen.
A. 
This article shall not apply to the Police Department or Fire Department of the City.
B. 
The Chief of Police, upon due cause shown, may permit the use of the restricted area free from any cost to the user.
C. 
Aldermen shall be entitled to receive a parking sticker or placard for their vehicle which entitles them to park in parking meter spaces for free while they are conducting City business.

Parking meters shall be installed, operated, maintained, policed and supervised on the restricted streets, lots and garages as designated in this chapter. Such parking meters shall be so devised and regulated as to provide for parking periods not in excess of the legal time limit within the restricted streets, lots and garages.
Each parking meter installed shall indicate by proper legend the legal parking time.
A. 
The parking fee for all public metered parking lots, garages and metered on-street parking shall be as follows:

(1) 
In Zone I, $0.25 per 15 minutes.
(2) 
In Zone II, $0.25 per 20 minutes.
(3) 
In Zone III, $0.25 per 30 minutes.
(a) 
The parking fees in Subsection A(3) above, which includes the metered spaces in the Elm Street and High Street parking garages, shall not be enforced from December 6, 2021, through January 1, 2022.

B. 
Multi-day parking permits can be purchased for metered spaces in the Elm Street parking garage at a cost of $10 per day. Prepaid monthly permitted garage spaces shall be $30 per month for rooftop spaces or $45 per month for street- or middle-level spaces. City Hall employees shall be provided free parking on the second and third levels of the Elm Street parking garage. The foregoing notwithstanding, the monthly fee for persons aged 62 and greater residing within 300 feet of either the High Street or Elm Street parking garage shall be $25 per month. The Parking Department Manager, or a person designated by said Manager shall maintain a record and validate the name, address and age of those persons who are eligible as indicated in this section. The daily time limit for which all of these reserved parking spaces are leased shall be from 7:00 a.m. to 5:00 p.m. daily. The reserved parking space regulations shall not apply on Saturdays, Sundays and legal holidays.

C. 
Issuance of permits.
(1) 
The Aldermanic Infrastructure Committee may, upon request by owners or tenants of property or employers of businesses located within a reasonable distance of Temple Street, Riverside Park, Library, Water Street, Pearson Avenue, Maple Street, High Street (behind 55 taxi stand), Spring Street, Factory Street, and Crown Street Park and Ride municipal parking lots, authorize the issuance of reserved parking permits, provided that an ample number of unused spaces are available on a regular basis to accommodate such reserved spaces. The fee for each parking space shall be $50 per month, payable on a quarterly basis if issued to a business or corporation and on a monthly basis if issued to an individual. The daily time limit for which these reserved parking spaces are leased shall be from 7:00 a.m. to 5:00 p.m. daily. The reserved parking space regulations shall not apply on Saturdays, Sundays and legal holidays.

(2) 
Requests for such reserved spaces shall be made to the Parking Department Manager, or a person designated by said Manager, who shall forward the request to the Infrastructure Committee. If the Infrastructure Committee determines that adequate unused spaces exist, then it may authorize the issuance of permits by the Parking Department Manager, or a person designated by said Manager.

(3) 
Once approved by the Infrastructure Committee and payment of the permit fee is made, the person making the request shall obtain a permit from the Parking Department Manager, or a person designated by said Manager. The permit fee shall be paid in advance of the permit period. The applicant shall complete an application form, which shall indicate the applicant's name, business and residence address and telephone numbers for which the permit is to be issued, the expiration date, and the name of the parking lot for which the permit issued. The City will provide a card or other device identifying the location of the parking lot for which the permit is issued, the name of the company leasing the parking space, and the date of expiration of the permit.

(4) 
Parking permits shall be displayed on the driver's side of the dashboard of the vehicle for which the permit is issued and shall be positioned so as to be easily seen through the windshield of the vehicle. Vehicles may only be parked in spaces designated for reserved parking and only within the area specified on their permit and on the posted signing.
(5) 
Permits are not transferable, and the permit holder is responsible for ensuring a timely renewal of the permit. Permits may be revoked by the Parking Department Manager, or a person designated by said Manager, upon the giving of sufficient notice to the permit holder.

(6) 
Vehicles which do not properly display a valid permit shall be subject to the penalties of this chapter.
D. 
The Parking Department Manager, or a person designated by said Manager, is authorized to issue meter bags or traffic cones to the owners/operators of downtown businesses for the purpose of facilitating construction renovation or weddings. Unless used by the City or for funerals or weddings, each meter bag or traffic cone shall cost $10 per day, per space, paid in advance. The person using the meter bag or traffic cone shall remove it after the authorized period of use has expired and return them to the Parking Department Manager. No meter bag shall be issued for a period longer than two weeks, at which time a business may apply for an extension of time. No more than four parking spaces for no more than two hours may be reserved per wedding.

E. 
Upon authorization by the Infrastructure Committee, the City may lease parking lots or spaces to non-City entities at a rate approved by the Infrastructure Committee. In addition, the City has authorized the following:

(1) 
The City leases 100 parking spaces to the Senior Activity Center for free.
(2) 
Dalianis House may obtain up to eight prepaid yearly parking permits for one of the metered parking spaces under the Water Street Bridge for $10 per permit per year for residents of Dalianis House. The daily time limit for which these reserved parking spaces are leased shall be from 7:00 a.m. to 5:00 p.m. daily. The reserved parking space regulations shall not apply on Saturdays, Sundays and legal holidays.

G. 
Agreements for reserved parking spaces in City-owned parking lots and garages shall be subject to the following conditions:
(1) 
Motor vehicles parked in such spaces must have valid, unexpired registration and inspection.
(2) 
No repair or maintenance shall be performed on motor vehicles parked in such spaces, except for emergency measures necessitated by an unforeseen breakdown and necessary to render a vehicle operable.
H. 
In addition to revocation of reserved-space parking permits by the Aldermanic Infrastructure Committee, owners and operators of motor vehicles parked in violation of Subsection G shall be subject to fine under § 1-12 of the Code of the City of Nashua, and such vehicles shall be subject to towing at the owner's expense.
I. 
Anyone eligible for a Nashua Library card who has a valid, current high school or college identification card may be allowed to park in the Library parking lot at no cost for a period of time not to exceed three hours while using the Nashua Public Library. Students may check out and use one of a fixed number of available parking passes by presenting a valid, current high school or college identification card at the library information desk. The total number of parking passes available at one time will not exceed 20 passes, and the total number available will be set and adjusted based on usage. The student will need to properly place the parking pass in their vehicle. When the parking pass is returned to the library information desk, the student will get their identification card back. This program will operate as a pilot program with an expiration date of June 16, 2020. However, 60 days prior to expiration a report by the Youth Advisory Committee, along with the Nashua Library and the Economic Development Committee, will be made to the Board of Aldermen to review the outcome of this pilot program and consider continuation.

A. 
The fact that time has expired on any parking meter shall be presumptive evidence that the person who parked the vehicle then found standing in the parking space controlled by the meter failed to pay a fee as required therein; and the indication by the meter of illegal parking shall be presumptive evidence of overtime parking.

B. 
Any overtime parking violation under this article shall raise the presumption that the vehicle involved was operated by the person in whose name the vehicle is registered.
Any designated parking meter space may be used by more than one but not to exceed three motorcycles, mopeds or similar motor vehicles, provided that the meter fee is paid in accordance with this article, and provided that no vehicle using the space extends outside the space designated.
