The owner or owners, tenant or tenants of any land abutting upon public streets, avenues and highways of the Township of Westampton shall remove all snow and ice from the abutting sidewalks on such public streets, avenues and highways within 12 hours of daylight after the same shall fall or be formed thereon. In the event of ice which may be so frozen as to make removal impracticable, the owner or owners, tenant or tenants of lands abutting or bordering upon public streets, avenues or highways shall cause the same to be thoroughly covered with sand, ashes or rock salt within 24 hours after the snow shall cease to fall or be formed thereon.
In addition to the penalties herein provided, if the owner or tenant of any such premises shall neglect or refuse to comply with § 212-1 of this Code, it shall be the duty of the Department of Public Works, when practicable, to notify the owner or tenant of the noncompliance and request the removal of said snow and ice and inform the owner or tenant that the failure to so remove shall result in the removal of said snow and ice by the Department of Public Works and the imposition of the costs of said removal as a lien against the land. Upon the failure of the owner or tenant to remove the snow and ice within the period of time specified in the notice, not to exceed 24 hours, the Department of Public Works shall forthwith remove said snow and ice from the sidewalk of the offending owner or tenant. The head of said Department shall thereupon certify to the governing body the cost of such removal, which cost shall be charged against the land abutting or bordering upon such sidewalks, and the amount so charged shall forthwith become a lien upon such land and shall be added to and become part of the taxes next to be assessed and levied upon such land and shall bear interest at the same rate as taxes and shall be collected and enforced in the same manner as taxes.
Any owner or owners, tenant or tenants who shall violate any of the provisions of this article shall, upon conviction before the Judge of the Municipal Court of the Township of Westampton, be subject for each offense to a fine not exceeding $500 or to imprisonment for a term not exceeding 90 days, or to both such fine and imprisonment. Each and every twenty-four-hour period that such violation continues shall be considered a separate and distinct offense.
