On application to the Township, the Township may permit the outdoor display and/or sale of goods on sidewalks and adjoining areas, but not on streets, subject to the conditions contained herein. Such display and/or sales shall be made only subsequent to the issuance of permits by the office of the Municipal Clerk/Administrator once said Clerk/Administrator is satisfied that the criteria herein established for such sales have been met.
A permit for outdoor display and sales shall be given to an applicant if the applicant satisfies all of the following criteria:
A. 
The outdoor display and sales shall be restricted to areas zoned for business and be in accord with all zoning regulations[1] pertaining thereto.

B. 
The outdoor display and sales shall be a part of a program sponsored by a bona fide commercial or mercantile organization, hereinafter referred to as the "sponsoring organization."
C. 
All participating displayers or sellers shall own or lease permanent premises within 25 feet of the place where the outdoor display or sale will be conducted.
D. 
The sponsoring organization can demonstrate that the outdoor display and sales serves the public purpose of furthering the commercial and mercantile growth and stability of the Township at large.
E. 
The permit would not adversely affect the public welfare.
F. 
The applicant must be in possession of an active mercantile license issued by the Township of Westampton.
G. 
This article does not apply to the sale of personal property from the premises of Westampton Township homeowners.
This article shall be enforced by the Westampton Township Police Department.
Any person who violates or who fails or refuses to comply with any section of this article or the enabling resolution or permit or conducts a sale without a permit shall be subject to a penalty up to $500 for each event or for each successive day of violation after having received notice that said person is or may be violating the conditions of this article.
