A change of use within the Township of Westampton
will void the previously issued certificate of occupancy and require
the issuance of a new certificate of occupancy. The Building Inspector
or Zoning Officer may require submission of new site plan review,
even though no construction is planned with the conversion of the
use, if he finds that increased traffic will result, that off-street
parking facilities should be expanded or that buffering and/or screening
may be necessary.
No building shall be occupied or used until
such time as a certificate of occupancy is issued by the Building
Inspector after determination that the building, structure or use
is in conformance with the provisions of this chapter.
[Amended 11-10-1998 by Ord. No. 24-1998]
Any variance hereinafter granted by the Zoning
Board of Adjustment or Land Development Board pertaining to the erection
or alteration of any structure or structures or permitting a specified
use of any premises shall expire unless such construction or alteration
shall have been actually commenced on each and every structure permitted
by said variance or unless such permitted use has actually been commenced
within one year from the date of publication of the notice of the
judgment or determination of the Board.
The Zoning Officer is charged with the primary
duty of enforcement of this chapter. Any citizen of the municipality
may bring a proceeding in Municipal Court alleging a violation of
this chapter, including nonpayment of fees, escrows, inspection fees
or other costs. This chapter may also be enforced by the administrative
officer of the municipality by instituting a proceeding in the Municipal
Court of the municipality alleging a violation of this chapter.
All development in the Township shall comply
with all applicable standards and procedures of this chapter, as well
as all applicable standards and procedures of the Township Land Subdivision
and Site Plan Ordinances and the administrative procedures and fees
of the Land Use Procedures Ordinance.
This chapter shall take effect immediately upon
final passage and publication as provided by law and the filing of
a copy of said chapter with the Burlington County Planning Board.
