This article shall apply to all public parks and public park approaches owned by the Town of Cheektowaga.

All public meetings and military and other parades are prohibited in said parks except with permission of the Town Board.
All games of any description must be conducted in a safe and orderly manner, and no dangerous practices shall be allowed. No person shall play games for which the Town Board has by resolution required a permit or fixed a fee without first obtaining such permit or paying such fee.
No person shall hold a picnic in any park except at those places authorized therefor.
Permits for the exclusive use of any picnic area for any specified time not longer than one day may be granted by the Town Board or by such other official to whom the Town Board shall delegate such authority, and no person shall in any manner disturb or interfere with any person or party occupying such picnic area under the authority of such permit.
No person shall climb any tree to pick any flowers or fruit or break, cut down, trample upon, remove or in any manner injure or deface any tree or shrub or any building, fence, bridge or structure or any other property within a park or park approach.
No person shall deposit, dump, throw or place any earth, rubbish, dust or similar material in or upon any part of a park or park approach except in such receptacles as are provided for same.

Smoking shall be prohibited and no person shall smoke within the area (inside and outside any buildings) designated as the Cheektowaga Cultural Center. The Cheektowaga Cultural Center shall include the stage area, the bleachers, seating areas and the land within the fenced-in area around the Cultural Center (including the Lion’s Pavilion/mega-shelter). For purposes of this section, “smoking” means the burning of a lighted cigar, cigarette, pipe or other matter or substance which contains tobacco.

A.
Dogs shall be permitted in Town parks, except for John C. Stiglmeier Park and Cheektowaga Town Park, subject to the following conditions/limitations:
(1)
Dogs must be restrained/hand-controlled by leash (no longer than six feet in length);
(2)
No person walking or in charge of any dog in said area(s) shall cause, suffer or allow such dog to soil, defecate on or commit any nuisance in said area (unless said person picks up and properly disposes of the feces in an appropriate container); and
(3)
Dogs shall not be permitted on any park lands designated for sport fields and/or in areas immediately adjacent to playground structures.
B.
Dogs shall be permitted in the area designated as the Alexander Walking Path (described as follows: the park area/walking trail area on the east side of Scajaquada Creek west and north of the Alexander Community Center, but not including any area east of the parking lot for the Cheektowaga Recreation Center/Ice Rink building), subject to the conditions and limitations contained in Subsection A(1), (2) and (3) of this section.
No person shall bathe or swim in any water, whether natural or artificial, within a park or park approach, except at such times and in such places as said Town Board may designate or maintain as bathing or swimming areas, and unless properly attired. No person shall dress or undress in any park or park approach, except in such places as may be designated or maintained for that purpose.
No person shall skate, use a sleigh, walk or go on any frozen area of water, natural or artificial, within any park or park approach, except at such times and in such places as may be designated therefor. No person shall, in any park or park approach, coast with sleighs or other similar vehicle, except at such times and upon such places as may be designated therefor.

No person shall operate a bicycle within the limits of any park or park approach unless he or she shall wear a protective helmet. Such a helmet must be equipped with either a neck or chin strap, be reflectorized on both sides thereof and be American National Standards Institute (ANSI) approved.
Every fire shall be built in a suitable container and be continuously under the care and direction of a competent person from the time it is started until it is extinguished.

A.
No person under the age of 21 years shall consume any alcoholic beverage or have in his possession any open container containing an alcoholic beverage, with the intent to consume the same, within the limits of any park or park approach.
B.
No person shall consume any alcoholic beverage or have in his possession any open container containing an alcoholic beverage, with the intent to consume the same, within the limits of any park or park approach; except that this prohibition shall not apply to persons over the age of 21 years picnicking in Town Park or John C. Stiglmeier Park during regular park hours.
All parks shall be closed between the hours of sunset and sunrise the following morning, and no person shall remain inside any park during the hours when so closed, except that any park which has a lighted baseball or softball diamond shall remain open after sunset when baseball or softball games are being played on such lighted diamond. Such park shall be open only to players, officials and spectators involved in such baseball or softball games. Such players, officials and spectators must remain in the immediate vicinity of the lighted diamond or diamonds. "Immediate vicinity" excludes picnic areas, shelters, trails, playground areas and other athletic facilities. Comfort stations and vehicular roads for access and egress are constituted as being within the vicinity of a lighted diamond. The park shall be closed to the public 15 minutes after the conclusion of any such game.
No person shall operate any motor vehicle at a speed in excess of 15 miles per hour on any of the driveways of the parks or park approaches, and no motor vehicle shall be allowed to remain in any park or park approaches for more than 24 hours continuously.
No commercial vehicle shall be allowed in any park or park approach except to make deliveries in the park or as otherwise authorized by the Town Board.
The following vehicles shall not be allowed in any part of the parks, driveways of the parks and/or park approaches:
A.
Snowmobiles, skidoos, skidaddlers or any such mechanized motor-driven sled or vehicle on runners.
B.
All-terrain vehicles or any such one-passenger or two-or-more-passenger vehicles equipped with between two and six high-flotation or similar type tires per vehicle designed for operation primarily on off-highway trails or in off-highway competitions and only incidentally operated on public highways.
No parking shall be permitted except in designated areas.
Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be guilty of an offense and shall be subject to the payment of a fine not exceeding $200 or to imprisonment for a period not exceeding 90 days, or both.
This article shall take effect 10 days after publication and posting as required by § 133 of the Town Law, but such article shall take effect from the date of its service against a person served personally with a copy thereof, certified by the Town Clerk under the Corporate Seal of the town and showing the date of its passage and entry in the minutes of the Town Board.
