Unless the context of usage indicates otherwise, the meaning of specific terms in this chapter shall be as follows:
Any waste having a total suspended solid, BOD or total phosphate concentration in excess of that found in normal strength sewage, but which is otherwise acceptable into a public sewer under the terms of this chapter.
The Federal Clean Water Act, as amended.
The American Society for Testing and Materials.
A principal executive officer of at least the level of vice president, if the industrial user is a corporation;
A general partner or proprietor if the industrial user is a partnership or proprietorship, respectively;
A duly authorized representative of the individual designated above if such representative is responsible for the overall operation of the facilities from which the indirect discharge originates.
The quantity of oxygen used in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
The Buffalo Sewer Authority.
That part of the lowest horizontal piping of a drainage system which received the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet (1.5 meters) outside the outside face of the building wall.
That sewer which is the responsibility of the owner from the building drain to the publicly owned treatment works.
National Categorical Pretreatment Standards or pretreatment standard.
A sewer intended to receive both wastewater and storm or surface water.
Includes any property occupied by a nonresidential establishment not within the definition of an "Industrial User (Class III)," and which is connected to the publicly owned treatment works.
The twenty-four-hour period beginning at 12:01 a.m.
A combination of the water-carried normal strength sewage from residences, business buildings, institutions and industrial establishments.
An acquired legal right for the specific use of land owned by others.
The Town Engineer of the Town of Cheektowaga or his authorized representative.
The United States Environmental Protection Agency.
The solid animal and vegetable wastes resulting from the domestic or commercial handling, storage, dispensing, preparation, cooking and serving of foods.
A tank or trap installed in a building drain or sewer to prevent grease from entering the publicly owned treatment works.
Water within the earth.
Any nonresidential or noncommercial user identified in Division A, B, D, E or I of the Standard Industrial Classification Manual. "Class III" shall also include any user which discharges or may accidentally discharge wastewater containing toxic or poisonous substances or any substance(s) which cause(s) or have (has) the potential to cause interference in the publicly owned treatment works.
Inhibition or disruption of any sewer system, wastewater treatment process, sludge disposal system or their operation, which substantially contributes to a violation of applicable discharge permits.
Any outlet into a watercourse, pond, ditch, lake or any other body of surface or groundwater.
The person or persons who legally own, lease or occupy private property which discharge or will discharge to the Town's publicly owned treatment works.
Any individual, firm, company, association, society, partnership, corporation, municipality or other similar organization, agency or group.
The logarithm of the reciprocal of the hydrogen ion concentration expressed in grams per liter of solution as determined by Standard Methods.
The total quantity of phosphorus contained in a particular waste.
Any dredged spoil, solid waste, incinerator residue, sewage, garbage, sewage sludge, munitions, chemical wastes, biological materials, radioactive materials, heat, wrecked or discharged equipment, rock, sand, cellar dirt and industrial, municipal and agricultural waste discharged into water.
The reduction of the amount of pollutants, the elimination of pollutants or the alteration of the nature of pollutant properties in wastewater prior to discharge to the Town's publicly owned treatment works.
Any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act, which applies to industrial users. This term includes prohibitive discharge limits established herein in accordance with 40 CFR 403.5.
A treatment works as defined by Section 212 of the Act (33 U.S.C. § 1292) which is owned in this instance by the Town. This definition includes any sewers that convey wastewater to the POTW treatment plant. For the purposes of this chapter, "POTW" shall also include any sewers and treatment plant(s) which convey or treat wastewater from the Town.
That portion of the publicly owned treatment works designed to provide treatment to wastewater discharged to the POTW.
All premises used only for human residency and which is connected to the POTW.
Retail establishments selling prepared foods and drinks, caterers and industrial and institutional food service establishments and shall include but not be limited to all establishments with a Standard Industrial Classification Manual Group No. 58.
Wastewater discharged from the sanitary conveniences of dwellings, office buildings, commercial establishments, industrial plants or institutions.
An industrial user of the publicly owned treatment works that:
Is subject to EPA Categorical Pretreatment Standards;
Uses or stores substances that may inadvertently be spilled into the POTW and which may potentially have an adverse impact on the POTW;
Is ICS positive (e.g., industries which annually use more than 1,000 gallons or 10,000 pounds of a NYS substance of concern);
Discharges greater than 25,000 GPD;
Has previously been issued a BSA SPDES permit;
Is surchargeable; and/or
Is a major discharger of any pollutant which could potentially have an adverse impact on the POTW.
State Pollutant Discharge Elimination System permit program administered by the State of New York.
A classification pursuant to the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972.
The latest edition of Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, Water Pollution Control Federation and American Water Works Association.
The State of New York.
A sewer for conveying stormwater, surface water and other waters, which is not intended to be transported to a POTW treatment facility.
Water which occurs when the rate of precipitation exceeds the rate at which water may infiltrate into the soil.
The total suspended matter that either floats on the surface of or is in suspension in water or wastewater, as determined by Standard Methods.
The Town of Cheektowaga or its authorized representative.
The Town Engineer of the Town of Cheektowaga or his authorized representative.
A Town of Cheektowaga Code Enforcement Officer, Assistant Code Enforcement Officer, Plumbing Inspector, Assistant Plumbing Inspector, Zoning Inspector, Town Planner, Housing Inspector, Fire Inspector and Supervising Code Enforcement Officer.

Any of the pollutants designated by Federal regulations pursuant to Section 307(a)(1) of the Act.
Any person who contributes, causes or permits the contribution of wastewater into the Town's POTW.
A combination of liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with any groundwater, surface water or stormwater that may be present.
The structures, processes, equipment and arrangements necessary to collect and transport wastewaters to the POTW treatment facility.
The combination of the wastewater sewers and treatment facilities.
The structures, processes, equipment and arrangements necessary to treat wastewaters and discharge.
The Water Pollution Control Federation.

"May" is permissible; "shall" is mandatory.
