The provisions of Article 19-A of the General Municipal Law are hereby applicable to the establishment or extension of Business Improvement Districts in the City of Hornell.

The Hornell Business Improvement District shall be and is hereby established in the City of Hornell, the Common Council having found that the establishment of the district is in the public interest, that all notice, mailing and hearing requirements have been complied with, that all properties within the district will benefit from the establishment and that all property benefitted is included in the boundaries of the district. The boundaries of said district are contained in the District Plan adopted by this body on November 13, 1995, and as set forth below:
   All businesses on both sides of the center line of the streets as described beginning at intersection of Cedar Street and Park Drive; thence northwest along Park Drive to Mill Street; thence west on Mill Street to Canisteo Street; thence north along Canisteo Street to Pleasant Street; thence west along Pleasant Street to Grand Street; thence northerly along Grand Street and a line extending to Franklin Street; thence east along Franklin Street to property owned by Conrail; thence northwesterly to West Street; thence northeast along West Street to Buffalo Street; thence northwest along west boundary of Conrail-Buffalo Division Track to the westerly boundary of West Main Street; thence Northwest along West Main Street to the city's northwest boundary; thence follow city boundary to intersection with Rt. 21; thence east along Route 21 to intersection with Old Almond Road; thence east on Old Almond Road to intersect with North Main Street; thence northwest along North Main Street to Steuben Street; thence east along south boundary of Steuben Street to east boundary of Conrail property thence southeast along Conrail property to Ransom Street; thence east on Ransom Street to west boundary of Maple City Drive; thence north along Maple City Drive to east boundary of Canisteo River; thence northwest along city property line; thence east along city line to west boundary of Route 36; thence south along Route 36 to intersection with Adsit Street; thence east on Adsit Street to Seneca Street; thence north on Seneca Street to Canisteo River; thence south on Seneca Street to Maple Street; thence southeast on Maple Street to Church Street; thence southwest on Church Street to Main Street: thence southeast on Main Street to Center Street; thence southwest to Center Street to Elm Street; thence southwest on Elm Street to Jane Street; thence southwest on Jane Street to Transit Road; thence southeast on Transit Road to east boundary of Conrail property; thence southeast along Conrail property to a point opposite Cedar Street intersection with Park Drive; thence southwest across Conrail property to point of beginning.
The construction improvements and provision of services within the district shall be pursuant to such District Plan of the Hornell Business Improvement District. All said services shall be in addition to and not a substitution for required municipal services provided by the City of Hornell on a city-wide basis.
A. 
To the extent not otherwise explicitly provided herein, the provisions set forth in Article 19-A of the General Municipal Law shall govern the operation of the BID and the District Management Association in the City of Hornell.
B. 
Insofar as the provisions of this article are inconsistent with the provisions of any other local law or act, the provisions of this article shall be controlling.
Any amendments to the BID or to the BID Plan shall be made in accordance with the provisions set forth in § 980-i of Article 19-A of the General Municipal Law.
