The regulations set forth in this Article shall apply whenever a bicycle is operated upon any street or upon any public path set aside for the exclusive use of bicycles, subject to those exceptions stated herein.

For the purpose of this Article, the following terms shall have the meanings indicated:
BICYCLE
Every device propelled by human power upon which any person may ride, having two tandem wheels, either of which is over 20 inches in diameter.
No person who resides within the city shall ride a bicycle upon any street or upon any public path set aside for the exclusive use of bicycles unless such bicycle has been licensed by the city and a license plate has been obtained for such bicycle as hereinafter provided.

Application for a bicycle license and license plate shall be made upon a form provided by the city and shall be made to the City Clerk. A one-time fee as set forth in Ch. 142, Fees, shall be paid before each license or renewal thereof is granted.

A. 
The City Clerk, upon receiving a proper application therefor, is authorized to issue a one-time bicycle license, together with a license plate or tag, which shall be effective so long as the person securing the application owns the bicycle.

B. 
The City Clerk shall not issue a license for any bicycle when he knows or has reasonable ground to believe that the applicant is not the owner of or entitled to the possession of such bicycle.
The license plate issued pursuant to § 107-5 shall be attached to the rear mudguard or frame of the bicycle in such position as to be plainly visible from the rear, and it shall be the duty of each licensee to keep such license plate in a clear and legible condition.
The City Clerk shall keep a record of the number of each license issued under the provisions of this Article, the date issued, the name and address of the person to whom issued and the number on the frame of the bicycle for which issued and a record of all bicycle license fees collected by him.
The bicycle license provided for in this Article is not transferable. Upon the sale or other transfer of a licensed bicycle, the licensee shall remove the license plate therefrom. Upon proper application to the City Clerk made upon blanks furnished by the city and without fee, said plate may be assigned to another bicycle owned by the applicant.
Upon the expiration of any bicycle license, the same may be renewed upon application and payment of the same fee as upon an original application.
A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license plate is attached thereto as provided herein.

Every person convicted of a violation of any provision of this Article shall be punished as provided in § 1-1 of this Code.

It shall be unlawful for any person to operate or ride a bicycle within the confines of the area commonly known as the "Broadway Mall" in the City of Hornell.

Bicycles may be walked through the Canisteo Street Underpass, the Steuben Street Underpass and the Broadway Mall.
