It shall be unlawful for any person to be drunk or in a state of intoxication in any highway, street or public place in the city or in any private house or place to the annoyance of any person or persons.
No person shall raise a false alarm of fire knowing the same to be false.
No person shall keep any billiard table, pool table, bowling alley or other instrument or device for gaming upon which or with which games of chance shall be played for money, wines, liquors, beer, cigars or other articles.
A. 
No person shall willfully and unlawfully cut, injure, deface or tarnish any building, bridge, sign, fence, awning or other useful or ornamental improvement or any public work in the city or willfully and unlawfully break any window or window glass in any private or public building or place of worship in the city or the glass of any public lamp or aid, abet or assist therein.
B. 
No person shall display upon any property belonging to the city, including buildings, sidewalks, street signs, traffic lights or other municipal property, any sign, advertising, writing, picture or character of any kind.
C. 
It shall be unlawful for any person to paint, print or draw any work, words, design, figure or sign upon any sidewalk within the city.
D. 
No person shall unlawfully ride or drive any horse, team, carriage, wagon or other vehicle on any burial lot or on any of the margins, footwalks or walks in any cemetery of the city. Nor shall any person unlawfully tread down the grass or cut, break or remove any tree, shrub, plant, flower or turf in or from any cemetery in the city.
E. 
No person shall remove, mutilate, deface or destroy or in any manner unlawfully interfere with business or other signs or advertisements of any description.
It shall be unlawful for any person to hinder or obstruct or attempt to hinder or obstruct any officer of the city in the legal discharge of his duties.
It shall be unlawful for any person to intentionally hinder, obstruct or interfere with any person employed by the city in the construction of any public work.
No person shall solicit alms within the city without the written permission of the Mayor, the City Clerk or the Chief of Police.
It shall be unlawful for any person to spit:
A. 
Upon any sidewalk.
B. 
Upon the floor or any other part of any public conveyance.
C. 
Upon the floor or any part of a public building, theater or store.

Any violation of the provisions of this chapter shall be punishable as provided in § 1-1 of the Code.

A. 
Smoking, vaping, use of cannabis and all other tobacco use is prohibited within 30 feet of any and all school bus stops within the City of Hornell while students are present waiting to enter a school bus or discharging from a school bus.
B. 
For the purposes of this section, a "school bus stop" shall be defined as any location within the City of Hornell where a school bus stops either to pick up or discharge students going to or coming from school and/or school activities.
C. 
A violation of this section shall carry a fine of not less than $50 and no more than $250 for each offense.

A. 
Smoking, vaping, cannabis use and all other tobacco use is prohibited within the City of Hornell municipal parks.
B. 
For the purposes of this section, a municipal park includes, but is not limited to, Veteran's Park, Shawmut Park (including Shawmut Trail) and any City-sponsored summer recreational program, including, but not limited to, the former Bryant School, Stephens Street and Madison/Sheldon Avenue.
C. 
A violation of this section shall carry a fine of not less than $50 and no more than $250.
