[Adopted 5-25-1995 as L.L. No. 1-1995]
The purpose of this Article is to annex approximately 80 acres of land (as hereinafter described) owned by the City of Hornell Industrial Development Agency into the City of Hornell. This Article is made pursuant to:
A. 
Request and permission of City of Hornell Industrial Development Agency as owner of the property to be annexed.
B. 
Consent and approval to such annexation by the Town of Hornellsville as evidenced by a certain annexation agreement dated September 8, 1992, between the City of Hornell, the City of Hornell Industrial Development Agency and the Town of Hornellsville.
C. 
Approval and consent to such annexation by the Village of North Hornell as evidenced by an October 13, 1992, annexation agreement between the City of Hornell, The City of Hornell Industrial Development Agency and the Village of North Hornell.
D. 
Public hearings before the City Council on January 25, 1993, December 27, 1993, and May 24, 1995, concerning this proposed annexation.
E. 
Environmental Review Record for proposed Hornell Shopping Center which record includes: - DEIS dated April 1993.
F. 
Comments on DEIS received through June 1, 1993.
G. 
Response to comments on 4/93 DEIS as contained in a July 1993 document then entitled "Final Environmental Impact Statement" (hereafter 7/93 FEIS).
H. 
Supplemental Draft Environmental Impact Statement (SDEIS) dated March 20, 1995.
I. 
Comments on SDEIS and document dated May 12, 1995, entitled "Final Environmental Impact Statement (FEIS)."

The City of Hornell shall contain, on and after the effective date of this Article, in addition to the territory heretofore confined within its boundaries, the following described territory:
    All that tract or parcel of land formerly situate in the Village of North Hornell Town of Hornellsville County of Steuben, State of New York, and being more particularly bounded and described as follows:
    Beginning at a found iron pin, said pin being located on the westerly bounds of New York State Route 36 at the intersection of the northerly line of the parcel conveyed from SJM Properties, Inc. to the Hornell Industrial Development Agency by deed recorded in the Steuben County Clerk's Office on April 30, 1991, at Liber 1300 of Deeds at page 337; thence along the westerly bounds of Route 36.

The territory described above is hereby annexed to the City of Hornell pursuant to the provisions and authority of Article 17 of the General Municipal Law.
The territory hereby annexed to the City of Hornell shall be included in the First Ward Voting District of the City of Hornell. This designation is for administrative convenience insofar as no voters reside in such territory and it is not intended that any residences will be constructed in the annexed territory.
The territory hereby annexed to the City of Hornell shall be classified on the Official Zoning Map and in the official Zoning Code of the City of Hornell as B-2 Commercial, and such map and Code are hereby so amended.[1]
