The chapter hereby adopted and the New York State Uniform Fire Prevention and Building Code shall be enforced by the Chief of the Bureau of Fire Prevention, Fire Inspector or Assistant or Deputy Fire Inspectors of the Village of Montebello.
Any person who shall violate any provision or section of this chapter or who shall fail to comply therewith or who shall fail to obey any order or direction of the Chief of the Bureau, the Fire Inspector or any Deputy Fire Inspector, or who shall build or construct in violation of any statement of specifications or plans submitted shall, and severally, if there is more than one, for each and every such violation or noncompliance respectively, be liable to a fine of not more than $5,000 or imprisonment not exceeding 15 days, or both such fine or imprisonment. Each day that said violation or failure to comply continues shall be deemed a separate offense.
The enforcement officials, as designated in § 89-5, shall have the power, right and authority to issue an appearance ticket, as the same is defined in Article 150 of the Criminal Procedure Law of the State of New York.
Nothing contained herein shall be deemed to restrict or prevent the appropriate agency or the Village from instituting other and different proceedings, including injunctive relief and civil penalties.
A. 
The Chief of the Bureau of Fire Prevention, Fire Inspector or Assistant or Deputy Fire Inspectors may at all reasonable hours enter any building or premises for the purpose of making any inspection or investigation which, under the provisions of this chapter, may be deemed necessary.[1]

B. 
The Chief of the Bureau of Fire Prevention, or any inspector thereof, shall be permitted by the owner, lessee, manager or operator of any building or premises to enter and inspect his building or premises at the time and for the purpose stated in this section.
A. 
It shall be the duty of the Chief of the Bureau of Fire Prevention to inspect or cause to be inspected, by any inspector, all buildings and premises, except the interiors of dwellings, as often as may be necessary for the purpose of ascertaining and causing to be corrected any conditions liable to cause fire, endanger life from fire or any violations of the provisions or intent of this chapter and of any other ordinances affecting the fire hazard.
B. 
The Chief of the Bureau of Fire Prevention or any inspector, upon the complaint of any person or whenever he or they shall deem it necessary, shall inspect any buildings and premises within their jurisdiction.
C. 
The Chief of the Bureau of Fire Prevention or any inspector shall investigate the cause, origin and circumstances of every fire occurring in the incorporated Village of Montebello which is of an unknown cause or of a suspicious nature or involves the loss of life or injury to persons or has caused substantial property damage. Such investigation shall be made as soon as possible upon the occurrence of any such fire and, if it appears that the fire is the result of arson, the Fire Inspector shall immediately notify the proper authorities designated by law to investigate such matters.
A. 
The Chief of the Bureau of Fire Prevention and all inspectors charged with the enforcement of this chapter, while acting for the Village of Montebello, shall not thereby be rendered liable personally and are hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of official duties. Any suit instituted against any officer or employee because of an act performed in the lawful discharge of duties and under the provisions of this chapter shall be defended by the legal representative of the Village until the final termination of the proceedings. The Chief of the Bureau of Fire Prevention or any subordinates shall not be liable for costs in any action, suit or proceeding that may be instituted in pursuance of the provisions of this chapter and any official, officer or employee acting in good faith and without malice shall be free from any liability for acts performed under any of its provisions or by reason of any act or omission in the performance of the official duties in connection herewith.
B. 
The Chief of the Bureau of Fire Prevention shall not be liable under this chapter for any damage to persons or property by reason of the inspection or reinspection of buildings, structures or equipment authorized herein or failure to inspect or reinspect such buildings, structures or equipment or by reason of the approval or disapproval of any building, structure or equipment authorized herein.
