A permit is required to erect a fence. The applicant for a fence permit shall submit an application for the permit to the Building Inspector. The application for the permit must include:

A sketched plan for the fence that complies with all applicable laws; and
B. 
The permit fee set by resolution of the Board of Trustees.
A permit is required to erect a retaining wall. The applicant for a retaining wall permit shall submit an application for the permit to the Building Inspector. The application for the permit must include:

A sketched plan for the retaining wall that complies with all applicable laws; and
B. 
The permit fee set by resolution of the Board of Trustees.
A permit is required to erect a swimming pool. The applicant for a swimming pool permit shall submit an application for the permit to the Building Inspector. The application for the permit must include:
A. 
A sketched plan for the swimming pool that complies with all applicable laws; and
B. 
The permit fee set by resolution of the Board of Trustees.
A permit is required to erect a shed. The applicant for a shed permit shall submit an application for the permit to the Building Inspector. The application for the permit must include:
A. 
A sketched plan for the shed that complies with all applicable laws; and
B. 
The permit fee set by resolution of the Board of Trustees.
A. 
A permit is required to move a house or structure in or out of the Village of Pelham.
B. 
The applicant for the permit shall submit to the Building Inspector:
(1) 
A permit application;
(2) 
The permit fee set by resolution of the Board of Trustees;
(3) 
If the house or structure is being moved into Pelham,
(a) 
Proof that the Planning Board has approved the site plan for the new location of the house; and
(b) 
Evidence that the new location of the house meets all applicable zoning laws;
(4) 
An insurance policy of an insurance indemnity company authorized to do business in the State of New York, insuring the Village against liability or personal injury as well as property damage in the amounts set by resolution of the Board of Trustees. In addition, the applicant shall agree to hold the Village harmless from any damages to Village property or the property of others caused by the moving of the house or structure.
C. 
The applicant is responsible for obtaining the necessary clearances from the public utilities and coordinating their activities.
D. 
The Building Inspector shall have the right to reject an application if prevailing distances and conditions are a danger to Village streets, trees or public safety.
E. 
Trees may not be cut or removed without first obtaining the approval of the Village Administrator. The cost of cutting or removing any trees is the obligation of the permit applicant. Any trees that are cut or removed must be replaced by trees, the number and size of which will be determined by the Village Administrator.
When deemed necessary by the Building Inspector, a competent watchman shall be on duty at the worksite at all times while the work of construction, alteration or repair is not taking place.
A. 
Within building. Construction materials and equipment stored within the building shall be placed so they will not overload the construction, interfere with the safe performance of the work or create a fire hazard.
B. 
Outside building. When the Building Inspector deems it necessary, construction materials and equipment stored outside of the building must be secured and covered. Construction materials and equipment shall not be stored in the street without permission of the Building Inspector.
A. 
Waste materials and rubbish at a worksite shall not be stored or allowed to accumulate during construction, alteration or demolition either within a building or in its immediate vicinity, but shall be removed from the premises as rapidly as practicable.
B. 
If necessary, dry waste material and rubbish shall be wetted down to settle dust and prevent waste from blowing about.
After dark all pits, excavations, fences, barriers, builder's equipment, building materials or rubbish in or upon a street shall be illuminated and/or bear reflective devices approved by the Building Inspector.
Before the foundation walls of a building or structure are completed, provisions shall be made to prevent water from accumulating in the excavation or cellar.
A. 
No person shall do any wiring for the installation of any device, appliance or apparatus for the utilization of light, heat, power, or alarm system unless the person has an electrician license issued by the County of Westchester.
B. 
Unless a person has a plumber license or other authorization to work as a plumber granted by the County of Westchester, the person shall not conduct the trade, business or calling of a plumber. Such license or authorization is necessary to practice plumbing as defined in the New York State Uniform Building and Fire Prevention Code.
A. 
An electrical job permit is required to do any electrical work in the Village of Pelham. The applicant shall file with the Building Inspector a completed application form with a description of the work, any plans or diagrams that the Building Inspector deems necessary, and the permit fee established by resolution of the Board of Trustees.
B. 
An electrical inspector must approve all electrical work.
C. 
Before concealing any part of the electrical work from view, the electrical contractor must give the electrical inspector written notice of when the electrical work is ready for inspection.
D. 
Before connecting service lines or using the installation, the electrical contractor must obtain a certificate of approval from the electrical inspector.
E. 
All electrical work must receive an electrical inspection certificate from the electrical inspector.
F. 
After a certificate has been issued, the electrical inspector shall have the right to reinspect any work to ascertain if the work in question is kept in good condition and that no violation exists. The electrical inspector shall have the authority to turn off all current in excess of 50 volts when, in his opinion the condition of the installation is dangerous to life or property.
A. 
A plumbing job permit is required to do any plumbing work in the Village of Pelham. The applicant shall file with the Building Inspector a completed application form with a description of the work, any plans or diagrams that the Building Inspector deems necessary, and the permit fee established by resolution of the Board of Trustees.
B. 
No registered and licensed plumber shall sign specifications, drawings or plans for an unlicensed plumber or act as an agent for an unlicensed plumber.
C. 
Except for the repair and clearance of obstructions in piping, plumbers must give the Building Inspector notice of any repairs or alterations of plumbing systems before commencing such plumbing work.
D. 
The entire plumbing system within the building shall be subjected to tests as prescribed in the Uniform Code. The plumber shall perform such tests in the presence of the Building Inspector. All pipes must remain uncovered until they have successfully passed the test. The plumber must securely close all openings as directed by the Building Inspector. The use of wooden plugs for this purpose is prohibited.
A. 
It is illegal for water from a rain leader to flow upon the sidewalks, onto adjoining property or into the Village sanitary sewer system. The water from said leaders must be conducted by pipes laid below the surface of the sidewalk to the street gutter, to any dry well on the owner's property or to a Village storm sewer drain.
B. 
Except in emergency situations, all water pumped from basements or cellars, including groundwater periodically pumped from sump pits located in such basements or cellars, must be piped directly into a dry well on the owner's property or into a Village storm sewer drain.
On-site improvements that expand the property's impervious surfaces by 500 square feet or more must include provisions for retention of the stormwater runoff created by a two-and-one-half-inch rainfall.
The Building Inspector must approve the routing of pipes used to meet the requirements of §§ 34-39 and 34-40. If a Village sidewalk, curb or drain is involved, such work must satisfy provisions of the Village law governing street openings.
Any contractor or subcontractor doing work in the Village of Pelham shall, at his sole cost and expense, take out and maintain during the entire period of work in the Village liability insurance, in the form and with companies acceptable to the Village, sufficient to protect the contractor or subcontractor, its officers, agents and employees from any claims for damage to property and/or bodily injury, including death, arising directly or indirectly out of any work performed within the Village. The amount of such insurance shall be set by resolution of the Village of Pelham Board of Trustees. Each contractor also shall show, to the satisfaction of the Village of Pelham, proof of workmen's compensation at the level required for licensed contractors within the Village. Such requirements shall be adhered to whether or not Village permits are required for work performed.
An applicant may appeal the rejection of an application for a permit authorized by this article or any adverse ruling made by the Building Inspector pursuant to this article to the Board of Trustees within 10 days after notice of such rejection or adverse ruling by serving written notice on the Village Clerk. The Board of Trustees shall act upon such appeal at a regularly scheduled meeting.
