This chapter shall be known and may be cited as the "Village of Pelham Zoning Local Law of 1983."
This zoning chapter is adopted pursuant to the Village Law of the State of New York, Chapter 64, Article 6-A, of the Consolidated Laws,[1] and the amendments thereof and supplements thereto, for the purpose of promoting the public health, safety, morals and the general welfare of the community and in furtherance of the following related and more specific objectives:
A. 
To guide and regulate the orderly growth, development and redevelopment of the Village of Pelham in accordance with a comprehensive plan and with long term objectives, principles and standards deemed beneficial to the interests and welfare of the people.
B. 
To protect the established character and the social and economic well-being of both private and public property.
C. 
To promote, in the public interest, the utilization of land for the purposes for which it is most appropriate.
D. 
To secure safety from fire, panic and other dangers and to provide adequate light, air and convenience of access.
E. 
To prevent overcrowding of land or buildings and to avoid undue concentration of population.
F. 
To lessen and, where possible, to prevent traffic congestion on public streets and highways.
G. 
To conserve the value of buildings and to enhance the value of land throughout the Village.

A. 
Except as hereinafter provided, no building or structure or part thereof and no lot or land or part thereof shall hereafter be used except in conformity with the use regulations herein prescribed.
B. 
Except as hereinafter provided, no building or structure or part thereof shall hereafter be erected, structurally altered, enlarged or rebuilt except in conformity with all regulations governing the size, shape, location and required accessory service areas, site improvements and screening and landscaping herein prescribed.
In addition to complying with all the provisions of this chapter, the types of development or use set forth below shall require approval of a site plan by the Board of Trustees in accordance with the provisions of Chapter 79 of the Code of the Village of Pelham:
A. 
The erection of any building, other than a permitted accessory building, in any district.
B. 
The enlargement of any building other than a single one- or two-family residence or any existing building that is accessory thereto.
C. 
The substantial alteration or modification of land from its natural state, whether by regrading or the addition of structures other than buildings.
D. 
Any change in the use or intensity of use of premises, other than as above, which will require a substantial modification of existing means of ingress or egress, parking or loading facilities, drainage, utilities, landscaping, screening or outdoor lighting.
