The Intermunicipal Police Cooperation Agreement (the "agreement") among Souderton Borough, Telford Borough and Franconia Township (the "municipalities"), which is attached to and made a part of this article, is hereby approved and authorized.
The conditions of the agreement are as follows:
A. 
Each party to this agreement agrees that it may provide assistance in police protection to the other, said assistance to be rendered by police officers and with such equipment as is available and necessary.
B. 
Such assistance may be furnished upon request by the Chief of Police or officer in charge of the municipality requesting assistance, made directly to the Chief of Police or officer in charge of the municipality providing such assistance.
C. 
It is hereby agreed and understood that it is not mandatory under this agreement that assistance be furnished to a requesting municipality. The Chief of Police or officer in charge of the municipality receiving a request shall determine whether such assistance will be provided and will specify the nature of assistance to be rendered. Any assistance furnished may be withdrawn at any time by order of the Chief of Police or officer in charge.
D. 
Any police officer employed by a party to this agreement, serving within the territorial limits of any other municipality, pursuant to a request under this agreement, shall have all rights, authority and privileges of a police officer employed by the requesting municipality.
E. 
Supervision of any police officer serving within the territorial limits of any other municipality, pursuant to a request under this agreement, shall be vested in the Chief of Police or officer in charge of the requesting municipality.
F. 
Any police officer employed by a municipality to the agreement, serving within the territorial limits of any other municipality, pursuant to a request under this agreement, shall at all times remain the employee of the municipality originally employing him, and the municipality furnishing assistance shall at all times be responsible for his wages, workmen's compensation, appropriate insurance and all other duties and responsibilities pertaining to his employment. Any equipment used in furnishing such assistance shall be considered as equipment used in performance of police duties within the territorial limits of the municipality furnishing the equipment. No charge or expense shall be imposed against any party to this agreement for assistance rendered hereunder.
G. 
Anything to the contrary notwithstanding, the following situation shall be deemed to be a request for assistance under the terms of this agreement with the same force and effect as though a specific request were made by the Chief of Police or officer in charge of the municipality requesting assistance: a report that a police officer of a neighboring municipality is in dire need of assistance and unable to manually request said assistance, which report is received from a citizen believed to be responsible by the officer or department receiving the report.
H. 
Each party to this agreement shall provide to the other parties a list of all police officers employed, including names, rank and designation of full-time or part-time status. This list shall be corrected as required.
I. 
Each party to this agreement shall provide to the other parties a copy of the procedure for designating an officer in charge. This information shall be corrected and updated as required from time to time.
The duration of the term of the agreement is indefinite; subject, however, to termination by any of the municipalities on 30 days' notice.
The purpose and objectives of the agreement are to provide mutual aid or assistance in police protection and thereby to make available for use throughout the territorial limits of the municipalities the services of police employed by any of the municipalities.
There is no financing required to implement the provisions of the agreement.
The provisions of the agreement require no organizational structure and shall be implemented within the organizational structure of the police departments of the municipalities.
The provisions of the agreement do not require the acquisition, management or disposal of real or personal property.
