From and after the passage and approval of this chapter, it shall be
unlawful for any person or persons, copartnership, firm or corporation to
post or distribute, by throwing, handing, passing or placing, any handbills
or dodgers or any kind of advertising matter or device, newspapers or wastepaper
upon any street, lane, alley, wayside, sidewalk or public park or on poles
in or of the Borough of Oakmont; or to distribute or cause to be distributed
or throw from any vehicle on, in or along any of the highways of the borough
any such handbills or dodgers or any kind of advertising device or devices,
newspapers or wastepaper, and the distribution, posting or scattering of written,
printed or painted notices, handbills, placards, bills or posters or other
advertisement, within or along the limits of any such highway, street, alley
or public park or playground, or the placing, posting or painting or attaching
the same on public or private property, without the consent of the owner or
tenant lawfully in possession or occupancy thereof; or in any such manner
as to cause or permit the same to be blown over, across and upon any alleys,
streets, public highways, parks or public playgrounds, lands, buildings or
improvements, or to throw or cause the throwing or placing thereof or permitting
the same to remain, in, on or along streets, alleys, parks, playgrounds, streams,
brooks, sewers, river or river banks or other public places, all of which
is likewise hereby prohibited, until and unless a license or permit therefor
shall first be had as hereinafter provided, provided that nothing herein shall
be construed to prevent the posting of any notice required by law or order
of court to be posted, nor to the delivery of mail, newspapers or periodicals,
nor to the delivery of goods regularly delivered to a consignee.
No person, firm or corporation shall distribute or cause to be distributed
any advertising matter, circulars, handbills or other advertising matter or
devices within the Borough of Oakmont without first having obtained a permit
for the same from the Mayor or Borough Secretary of said borough.
No permit shall be issued unless the applicant shall have paid to the
Mayor or Borough Secretary a sum as set from time to time by resolution of
the Borough Council, per day, for each person distributing and an amount as
set from time to time by resolution of the Borough Council for each separate
advertising matter or device to be delivered.
No permit shall be issued except upon the condition that the distribution
of said advertising matter, handbills, circulars or other advertising matter
or devices shall be conducted in conformity with this chapter and so as not
to cause any public nuisance or annoyance.
Any person violating any of the terms and provisions of this chapter
shall, upon conviction thereof, be punishable by a fine of not more than $600,
plus costs of prosecution, and in default of payment of such fine and costs
by imprisonment for not more than 30 days. In addition thereto, upon conviction,
any permit issued to the party convicted under this chapter shall be revoked
and no further permit granted. Any person convicted under this chapter shall
have the right to appeal as in other cases of summary conviction.
