This article shall be known and cited as the "Open Space Use Ordinance of Montville."
The purpose of this article is to establish rules and regulations for the use and control of Montville-Fair Oaks Conservation Center located west of Fair Oaks School; Camp Oakdale which is bounded by Route 163, Oxoboxo Dam Road, and Simpson Lane; all land owned by the Town of Montville on PTA Lane excepting therefrom that land which was conveyed by the Town of Montville to the Montville Historical Society, any and all other lands dedicated to open space and owned by the Town of Montville in order to promote safety and protection of the persons using the property, and of the property.
Open space land shall be open to the general public from one hour before sunrise until one hour after sunset except as provided by special permit. Town officials may close any portion of Open Space land or the use of its facilities when it appears that the capacity of an area has been exhausted or the use of same would endanger the public safety.
Fishing is permitted on any open space land under the rules and regulations established by the State of Connecticut Board of Fisheries and Game.
Hunting and trapping is not permitted on any open space land.
Carrying and/or discharging of firearms is not permitted on open space land.
Swimming or wading is permitted only in such areas approved by the Health Officer of the Town of Montville, provided these areas are properly supervised with the approval of the Montville Parks and Recreation Commission.
Dogs and other domesticated pets are permitted on open space land, provided such pets are leashed and under the control of their owners or keepers at all times. The only exception to this rule is when a dog is within the confined fenced area of the Montville Dog Park.
Riding of horses or bicycles is permitted only on areas set aside for such purposes.
Overnight camping is permitted in areas designated for camp use by special permission from the responsible board or commission
Campfires may be kindled only in designated areas.
No person shall deface, remove, destroy, or otherwise injure, in any manner whatsoever, any structure, rock, tree, flower, shrub, or any other plant life; nor disturb or molest any bird or animal.
Refuse shall be placed in receptacles provided on the premises, or removed from the premises, and no person shall litter the grounds or waters of open space land.
Motorized vehicles may not be operated or parked on any open space land except in designated areas.
Violation of any provision of this article is sufficient cause for eviction, and any person who violates any provision shall be fined not more than $25 for each violation.
