No person, firm or corporation shall perform any work in or under any street, highway, alley, park or other public place within the limits of the Town of Montville or use any portion of any such street, highway, alley, park or other public place for the purpose of depositing or keeping any material to be used in the construction or repair of any building or other work, or place or suspend on or over any such street, highway, alley, park or other public place any ladder, barricade, scaffolding, staging or any other material, equipment or apparatus used in the construction, alteration or repair of any building or other work or blockade or obstruct any such street, highway, alley, park or other public place unless a permit shall have been granted in accordance with the terms of this article and this permit is visibly displayed at the site of said construction, repair, or other work.
A. 
Any person, firm or corporation desiring such a permit shall make an application therefor to the Director of Public Works on a form to be furnished by the Director of Public Works. Said application shall describe as nearly as may be the portion of the street or sidewalk desired to be used, the probable length of time of such use, the purpose therefor, the methods to be used in doing such work, and the person, firm or corporation doing the work and the name of the person, firm or corporation for whom or which the work is being done, and in addition the type of work to be done.
B. 
Such application shall contain an agreement signed by the person, firm or corporation doing the work to be bound by and comply with the provisions of this article. No permit shall be issued unless and until the applicant therefor has paid a permit fee. The permit fee will be $20 for the first workday plus $15 per each of the following workdays until satisfactory completion of the work.
No such permit shall be issued unless and until the applicant therefor has filed with the Director of Public Works a policy or certificate of insurance protecting the Town of Montville from any loss, liability or damage that may result or accrue from, or because of, the making, existence or manner of guarding the work or guarding and constructing any such work with limits of $1,000,000 for bodily injury liability, including wrongful death, and with limits of $1,000,000 for injury to or destruction of property. An applicant may, in lieu of filing a separate insurance policy or certificate therefor for each permit, file an insurance policy or certificate thereof annually.
A. 
Any person, firm or corporation using any street, highway, alley, park or other public place for any of the purposes herein regulated or making or maintaining any excavation or other work in any such street or alley shall keep the same adequately guarded by barricades and lights suitable for the purpose intended to protect persons and property from injury.
B. 
In the case of excavations, the excavation width shall be kept to a minimum and shall be subject to the approval of the Police Chief, and in no event shall more than one-half width of any street be rendered unavailable for travel in connection with any excavation, except that the Police Department with the concurrence of the Director of Public Works may authorize the rendering of more than one-half available for travel where it is necessary or feasible from an engineering standpoint. All work, including excavation work, shall be conducted in such a manner as to ensure the least obstruction to traffic practicable. The convenience of the general public and of the residents and occupants of property abutting and adjacent to the work area shall be provided for in an adequate and satisfactory manner.
C. 
When ordered by the Police Department or Director of Public Works, ramps, railings and covers shall be constructed and maintained for the safety and convenience of users of the street for such periods as the Police Department or Director of Public Works may deem necessary, having regard to the safety and convenience of the public. When the street, or sidewalk, or any portion of either, is to be blocked, temporary roadways, walks and approaches shall be constructed and maintained.
D. 
Materials stored within the limits of the street or upon Town property shall be placed so as to cause the least possible obstruction to the public. Proper and accepted methods of controlling dust, mud, and erosion shall be used.
E. 
In the case of excavations, it is the sole responsibility of any person, firm, or corporation making an excavation to abide by any and all General Statutes of the State of Connecticut, including the notification of Call Before You Dig, Inc., at the appropriate period prior to the intended excavation.
F. 
In the case of blasting, the applicant will also obtain a permit from the Fire Marshal which is issued in accordance with the General Statutes of the State of Connecticut.
G. 
All work shall conform to the Road Standards and Improvement Details for the Town of Montville.[1]

A. 
It shall be unlawful to use any street or alley or to perform any such work in any way contrary to or at variance with the terms of the permit therefor. In the case of excavations or tunnels, proper bracing shall be maintained to prevent the collapse of adjoining ground, and in excavations, the excavation shall not have anywhere below the surface any portion which extends beyond the opening at the surface.
B. 
Upon request, plans of proposed shoring, sheeting and bracing for excavations and tunnels shall be submitted to the Director of Public Works for his review and approval, and shall be used if the Director of Public Works determines that it is necessary for protection of the public or structures, or shall be used if it is required by Federal OSHA regulations. Approval of plans or methods proposed shall not relieve the permittee of any responsibility for the safety of the work.
C. 
No injury shall be done to any pipes, cables, or conduits in the making of such excavations, and notice shall be given to the persons maintaining any such pipes, cables, or conduits, or to the department charged with the care thereof, which are or may be endangered or affected by the making of any such excavation, before such pipes, cables, or conduits shall be disturbed.
Each excavation permit will remain valid for a period of 15 calendar days from the date of issuance, after which time it will expire.
It shall be unlawful to carry on the work beyond the expiration date of a permit unless an extension is applied for and issued by the Director of Public Works. The time limit, fee, bond and insurance requirements for an extension will be the same as those requirements for a permit.
A. 
Any person, firm or corporation making an excavation in or under any public street, highway, alley, park or other public place within the limits of the Town shall restore the surface thereof to its original condition.
B. 
All excavated material determined unsuitable for backfill by the Director of Public Works shall be removed from the site and replaced with suitable material approved by the Director of Public Works.
Any person, firm or corporation violating the permit requirement shall be fined $90 for working without having been granted a valid permit and $10 for not visibly displaying a valid permit at the site for which a permit was granted. A separate offense shall be deemed committed on each and every day during or on which a violation occurs or continues and shall be deemed an infraction.
