No person shall convey or cause to be conveyed upon or through the streets or sidewalks of the Town, ashes, dirt, rubbish of any kind or any other substance in such a manner and so insecurely covered that any part of the same is likely to escape from the vehicle in which the same is being conveyed and be deposited upon the ground or in the air to the discomfort or detriment of the public, or so as to become unsanitary or unsightly or to otherwise constitute a nuisance.
Any person violating the provisions hereof shall be fined not to exceed $5 for each offense.

For the purposes of this article, the following terms shall have the meanings indicated:
LITTER
Any discarded, used or unconsumed substance or waste material, whether made of aluminum, glass, plastic, rubber, paper, or other natural or synthetic material, or any combination thereof, including, but not limited to, any bottle, jar or can, or any top, cap or detachable tab of any bottle, jar or can, any unlighted cigarette, cigar, match or any flaming or glowing material or any garbage, trash, refuse, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic or paper containers or other packaging or construction material which has not been deposited in a litter receptacle.
A. 
No person shall throw, scatter, spill or place or cause to be blown, scattered, spilled, thrown or placed, or otherwise dispose of any litter upon any Town property or upon noncommercial or nonindustrial private property in this Town not owned by him, or commercial or industrial property whether owned by subject person or not, or in the water of this Town, including, but not limited to, any public park, forestland, recreational area, highway, road, street, alley, except:
(1) 
When such property is designated by the Town for the disposal of garbage and refuse, and such person is authorized to use such property for such purpose pursuant to the Town's regulations governing such use;
(2) 
Into a litter receptacle in such a manner that the litter will be prevented from being carried away or deposited by the elements upon any part of said private or Town property or waters.
B. 
Any person who violates any provision of Subsection A of this section shall be deemed to have committed an infraction. When any such litter is thrown, blown, scattered or spilled from a vehicle, the operator thereof shall be deemed prima facie to have committed an offense.
Violations of this article shall be punishable by a fine of $90 for each occurrence. Persons who wish to appeal the issued fine may do so by filing the appropriate appeal form within 30 days of the issuance of the fine with the Town Manager, who shall make a final determination.
