This article shall be known and may be cited as the "Tobey Pond Boat Ordinance."

For the purposes of this article, the following terms shall have the meanings indicated:
Any watercraft, including but not limited to row boats, canoes, sailboats, kayaks and so forth, which is launched from the Tobey Pond Recreation Area. This article shall not govern boats or wind surfboards launched from private property with the permission of the owners of such property.
No power-driven boats or wind surfboards are allowed on Tobey Pond.
No person shall operate a boat on Tobey Pond unless registered with the Town Clerk at Norfolk Town Hall, starting during the month of June each year.
No person shall operate a boat which does not meet all applicable equipment requirements of the United States Coast Guard, including but not limited to Coast-Guard-approved personal flotation devices of the proper size, Type I, II or III, for each person on board such boat. Additionally, any boat over 16 feet shall have a throwable Coast-Guard-approved Type IV flotation device.
No swimming shall be allowed from boats.
The Town of Norfolk registration number shall be displayed on each side of the bow of each boat in numbers no less than four inches high.
Boats may be parked and stored during the summer, at the owner's sole risk, in areas so designated. All boats must be removed from the Tobey Pond Recreational Area at the end of the regular swimming season.
Boats can only be launched at areas so designated.
Boating shall be allowed only during those hours which the Tobey Pond Area is open to the public, as established by the Board of Selectmen.
Any person violating any part of this article will be fined $100 per violation, per day.
