This article shall be known and may be cited as the "Playground Ordinance."
A. 
The following parcel of property owned by the Town of Norfolk is hereby dedicated as a playground solely for the uses and purposes set forth in this article: beginning at a set iron pin in a bituminous walk, which iron pin is the northeasterly corner of property of the Norfolk Library, Inc., and the northwesterly corner of the property herein being defined; thence along a curve to the left having a radius of 998.37 feet, a distance of 95.0 feet to a set iron pin, said pin being the southwesterly corner of the property herein being defined; thence south 75° 41' 23" east the distance of approximately 28 feet to the westerly edge of a three-foot bituminous walk, said point being the southeasterly corner of the property herein being defined; thence along the westerly edge of said bituminous walk in a northwesterly direction to the point and place of beginning. Said iron pins are shown on a map entitled "Property of the Norfolk Library, Inc., Greenwoods Road East, Norfolk, Connecticut," dated March 17, 1983, which is on file in the office of the Town Clerk of Norfolk.
B. 
Said property is dedicated as a playground for children not over six years of age, subject to the rules and regulations set forth in this article.
C. 
Said property is hereby designated as the "Blake Elin Vanderlip Playground."

The Board of Selectmen or its designee is authorized to erect, construct and maintain such playground equipment and other improvements on the playground as it, from time to time, deems proper.
The playground shall be open to the public every day of the year, from sunup to sundown. The Board of Selectmen may, from time to time, alter the days and hours that the playground is open. The opening and closing hours shall be posted at the playground for public information.
Any section or part of the playground may be declared "closed to the public" by the Board of Selectmen at any time and for any interval of time, either temporarily or at a regular and stated interval (daily or otherwise) and either entirely or merely to certain uses, as the Board of Selectmen shall find reasonably necessary.
A. 
Equipment and improvements. No person in the playground shall willfully mark, deface, disfigure, injure, tamper with or displace or remove any equipment, benches, paving, signs, notices, monuments or other structures located in the playground.
B. 
Trees, shrubs, lawns.
(1) 
Injury and removal. No person in the playground shall damage, cut, carve, transplant or remove any tree or plant or injure the bark or pick the flowers or seeds of any tree or plant. A person shall not dig in or otherwise disturb grass areas or in any other way injure or impair the usefulness of any plants.
(2) 
Climbing trees, etc. No person in the playground shall climb any tree nor walk, stand or sit upon monuments or fences or upon any other property not designated or customarily used for such purpose.
No person in the playground shall bring in or shall dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No such refuse or trash shall be left anywhere on the grounds of the playground, but it shall be placed in the proper receptacles where these are provided. If receptacles are not provided, all such rubbish or waste shall be carried away from the playground by the person responsible for its presence and properly disposed of elsewhere.
The playing of any games involving thrown or otherwise propelled objects, such as balls, stones, arrows, javelins or model airplanes, is prohibited. The playing of rough or comparatively dangerous games, such as football and baseball, is prohibited. Roller skating is prohibited.
No person shall sleep or protractively lounge on the seats, benches or other areas or engage in loud, boisterous, threatening, abusive, insulting or indecent language or engage in any disorderly conduct or behavior tending to a breach of the public peace in the playground.
No person in the playground shall:
A. 
Expose or offer for sale any article or thing, nor shall he or she station or place any stand, cart or vehicle for the transportation or display of any such article or thing.
B. 
Announce, advertise or call the public's attention in any way to any article or service for sale or hire.
C. 
Paste, glue, tack or otherwise post any sign, placard, advertisement or inscription whatever, nor shall any person erect or cause to be erected any sign whatever on the playground.
