The purpose of this chapter is to regulate new and replacement outdoor and in-ground fuel storage tanks, except for liquefied petroleum gas tanks installed, per the State Building Code and NFiPA 58.
A. 
Outdoor aboveground fuel storage tanks and in-ground fuel storage tanks are prohibited for all residential properties and, except as provided in Subsection C hereof, are prohibited for all commercial, industrial and municipal development.
B. 
Aboveground fuel storage tank placement within the confines of the dwelling or attached to the dwelling in a weathertight enclosure may be permitted where plans and specifications are submitted to and approved by the Town Building Official.

C. 
In-ground fuel storage tanks will be permitted for commercial, industrial and municipal uses where storage tank installations are designed and constructed in compliance with Connecticut Department of Environmental Protection standards.
A. 
"Replacement" shall mean the direct removal of an in-ground or aboveground fuel storage tank from its location or abandonment of a tank, in accordance with NFiPA-30, Section C-3, and the installation of such storage tank or another storage tank in place thereof. Nothing herein shall preclude the necessary maintenance or repairs of suction, inlet, gauge or vent lines; however, repairs to the storage tank itself shall be prohibited.
B. 
Residential use. Replacement of in-ground and outdoor aboveground storage tanks for residential use will not be permitted. In-ground tanks and outdoor aboveground storage tanks must be replaced with storage tanks located in the basement, garage or otherwise, as required in § 152-2A above.
C. 
Nonresidential use. Replacement of in-ground storage tanks and outdoor aboveground storage tanks not regulated by the Connecticut Department of Environmental Protection will not be permitted. In-ground tanks and outdoor aboveground storage tanks must be replaced with storage tanks located in storage areas or other suitable weathertight enclosures or as otherwise required in § 152-2A above.
A. 
No fuel storage tank shall be installed or replaced in the Town of North Branford except upon the issuance of a permit from the North Branford Building Department. Application for the appropriate permit shall be made in writing to the Building Department on forms prescribed by it and shall be accompanied by the required permit fee.
B. 
Installation or replacement of such fuel storage tanks shall be inspected and approved by the Building Department prior to its use.

Any person who violates any provisions of this code shall be fined not less than two hundred dollars ($200.) nor more than one thousand dollars ($1,000.) or imprisoned not more than six (6) months, or both, pursuant to Chapter 541, Part Ia, of the Connecticut General Statutes.
