Be it ordained by the Town Council of the Town of North Branford that
the following regulations be and they hereby are adopted to be in aid of the
enforcement within the Town of North Branford of all statutes of the State
of Connecticut.
No person, persons, firm or corporation shall install, maintain or service
oil burner or liquid petroleum gas or any type of natural or manufactured
gas-burning equipment in the Town of North Branford unless licensed to do
so by the Department of Consumer Protection of the State of Connecticut, according
to Chapter 393 of the Connecticut General Statutes.
A.
Before installing any oil burner or liquid petroleum
gas or any type of natural or manufactured gas-burning equipment, each license
holder shall file with the Building Official of the Town of North Branford,
upon forms furnished by the Building Official for that purpose, an application
for each installation permit and, if required by said Building Official, submit
plans for the work.
B.
Installation of any such equipment shall not commence
until a permit has been issued by the Building Official.
C.
Each such application for an installation permit shall be accompanied by a fee, as set forth in Chapter 123, Building Construction, of the Code of the Town of North Branford.
D.
No change or modification shall be made in plans for
which a permit shall have been issued without approval, in writing, by the
Building Official.
When any new installation is completed and ready for inspection, the
installer shall give notice to the Building Official. The Building Official
or the Fire Marshal shall promptly inspect the same not later than two (2)
days after receipt of such notice, exclusive of Saturdays, Sundays and holidays.
A.
The person, partnership or company to whom such installation
permit shall have been issued shall rectify all parts of the installation
found by the Building Official or the Fire Marshal, upon inspection, to violate
the Connecticut General Statutes, the State Building Code, the State Fire
Code (NFiPA) and this chapter, and shall do so immediately in any case where
the Building Official or the Town Fire Marshal shall have given notice of
imminent danger and, in any event, within five (5) days, exclusive of Saturdays,
Sundays and holidays.
B.
Whenever it is necessary for the Building Official or
Fire Marshal to make additional inspections because of faulty installations,
an additional fee of five dollars ($5.) shall be paid by the permittee for
each additional inspection.
A.
All oil burners, all oil-fired units and liquid-petroleum
gas units shall be of a type listed as approved by the State Building Code
and/or the State Fire Code.
B.
All tanks must be approved by the local Fire Marshal.
Any tank bearing the manufacturer's label or the Underwriters' Laboratories,
Inc. shall be deemed sufficient for the approval by the local Fire Marshal
without independent test being made thereof satisfactory to him.
C.
All tank filler and vent pipes shall be installed so
as to comply with the Connecticut General Statutes, the State Building Code
and the State Fire Code.
This chapter shall not be construed as to relieve from or lessen the
responsibility or liability of any person or persons owning, operating or
controlling or installing any oil-burning equipment for damage to person,
persons or property caused by any defect therein, nor shall the Town of North
Branford be held as assuming such liability by reason of inspection and supervision
authorized herein.
A.
Any person, firm or corporation violating any of the
provisions of this chapter which do not constitute violations of the Connecticut
General Statutes or State Fire Safety Code shall be fined not more than two
hundred dollars ($200.).
B.
Any violation of the Connecticut General Statutes or
the State Fire Safety Code shall be subject to the penalties provided in said
state laws and State Fire Safety Code, respectively.
This ordinance shall become effective on the first day of August, 1957.
