This article is adopted pursuant to the provisions of C.G.S. § 26-257a.
There is hereby established a Shellfish Commission of the Town of Old Lyme.
Such Commission shall have the responsibilities and powers which are set forth in C.G.S. § 26-257a(b), as the same may be amended from time to time.
Such Commission shall consist of three members who shall be appointed by the Board of Selectmen. The terms of the members first appointed shall be of such duration that the term of one member will expire on the second Monday of January in each of the years one, two and three years following the year in which his or her term became effective. Thereafter, members shall be appointed to serve until the second Monday in January in the year three years after the year in which their appointments shall have taken effect. A member shall continue in office for the term for which appointed and until his or her successor is duly appointed and qualifies. Any member may be removed by the Board of Selectmen for cause and, on request of such member, after a public hearing. Members appointed by the Board of Selectmen to fill vacancies shall serve for the unexpired term of the person whose place they are taking.
Such Commission is empowered to issue regulations pursuant to C.G.S. § 26-257a. Prior to the adoption or amendment of such regulations, the Shellfish Commission shall hold a public hearing in relation thereto, notice of the time and place of such hearing to be published in a newspaper having a general circulation in Old Lyme at least twice at intervals of not less than two days, the first not more than 25 days nor less than 15 days and the last not less than two days before such hearing. A copy of such proposed regulations or amendments thereof shall be filed in the office of the Town Clerk for public inspection at least 10 days before such public hearing.
Members of such Commission shall receive no compensation for their services but may be reimbursed out of moneys collected by such Commission for their necessary expenses incurred in the performance of their official duties.
