GENERAL REFERENCES

As used in this chapter, the following terms shall have the meanings indicated:
FENCE
A secure barrier or obstruction of not less than four feet in height, so constructed as to entirely enclose the particular swimming pool itself or the yard in which it is located or the entire property, and which shall bar all reasonable and normal access to the area except through a substantial self-closing and self-latching gate or gates of the same height as the fence, equipped with facilities for locking said gate or gates when the pool is unattended or unguarded.

PERSON
Any individual, firm or corporation having an interest in the lot or lots on which a swimming or portable pool is located, as owner, tenant, occupant, or the agent, servant or employee of such owner, tenant or occupant.
PORTABLE POOL
Any above-surface-type pool, not stationary or fixed and capable of being removed for storage.
PRIVATE SWIMMING POOL
Fill-and-draw, flow-through and recirculation pools, located outdoors, which are artificially constructed to provide recreational facilities for swimming, bathing or wading, and all equipment and appurtenances thereto.
No person shall construct, maintain or use, or cause, suffer or permit to be constructed, maintained or used, any swimming pool or portable pool on any lot or lots in the City of Northfield unless there shall be constructed and maintained a fence enclosing the area on which said swimming pool or portable pool is located.

Sections 338-2 shall not apply to portable pools less than 24 inches deep or having a surface area of less than 250 square feet.
The provisions of this chapter shall apply to swimming pools and portable pools now existing and to swimming pools and portable pools hereafter constructed; provided, however, that as to swimming pools and portable pools now existing and not enclosed by a fence, there is hereby established a period of 60 days from the effective date hereof within which to construct such fence.
The gate or gates in the fence shall be kept closed at all times, except when being used for ingress or egress, and shall be kept locked at all times when the swimming pool or portable pool is unattended or unguarded.
Nothing herein shall be deemed to alter, modify or repeal any additional requirements concerning the construction, maintenance or use of swimming pools or portable pools as provided in Chapter 215, Land Use and Development, the Building Code or any health regulations of the City of Northfield.
