Pursuant to the power of the Commissioners to raise revenue pursuant to Section 27 of 51 Delaware Laws, Chapter 237,[1] the Town establishes tax rates, capitation taxes, sewer and water rentals and other fees as follows:

An “infill lot” is an existing, undeveloped lot of record within the existing corporate limits of Bridgeville as of October 19, 2002. Each infill lot shall be entitled to one EDU at the infill residential impact fee rate as may be amended from time to time by the Commissioners.

A. 
Major industry:
(1) 
$7.10 per thousand gallons discharged per month for the first 5,000 gallons, $8.50 per thousand gallons discharged for the next 5,000 gallons and $13 per thousand gallons discharged for all usage over 10,000 gallons per month.

(2) 
All costs incurred by the Commissioners of Bridgeville in the enforcement and monitoring of the pretreatment program shall be reimbursed by the permittee to the Commissioners.
(3) 
Permit fee of $100.
B. 
Minor industry: same as Subsection A above.
C. 
Commercial: same as Subsection D below.
D. 
Residential: $24 for the first 2,500 gallons discharged per month; $7.10 per thousand gallons discharged per month for more than 2,500 gallons but less than 5,000 gallons; $8.50 per thousand gallons discharged for the next 5,000 gallons; and $13 per thousand gallons discharged for all usage over 10,000 gallons per month. However, regardless of use, the minimum charge of $24 will be assessed to all residential customers. All nonmetered customers shall pay a minimum monthly charge of $60 per EDU.

(1) 
Definitions. As used in this section, the following terms shall have the meanings indicated:
EQUIVALENT DWELLING UNIT (EDU)
A term used to express the load produced on a sanitary sewage system approximately equal to one dwelling place or 200 gallons per day.

Any day that a commercial, institutional or industrial facility is open for business.

(2) 
Calculation of sewer impact fee.
(a) 
For any commercial, institutional or industrial structure there shall be a sewer impact fee of $6,000 per equivalent dwelling unit (EDU), which is based on water consumption or sewer metering, with a minimum of one EDU.

(b) 
The number of EDUs for structures pursuant to Subsection F shall be estimated by the Town Engineer in accordance with the below listed table. After one year of operation, each structure with water usage in excess of 2,500 gpd shall be re-evaluated and the number of EDUs recalculated based on the following formula:

Sewage flow per year in gallons + (Production Days x 200 gal/day/EDU).
(c) 
The results will be rounded up to a full number. This impact fee adjustment shall be billed or refunded at the time of the next regularly scheduled billing.
(3) 
If two or more dwellings, apartments, stores, offices or industrial units are connected through a single lateral, impact fee payable under the foregoing schedule shall be computed as though each such store, office, or industrial unit were a separate property or user with a separate connection to the sewer.
(4) 
In the event that the Town of Bridgeville is not provided, upon request, with accurate information, including supporting documentation, to determine the number of employees or pupils using any property, or such other data as may be necessary to determine a user classification or rate, the Town of Bridgeville's estimate or determination thereof shall be conclusive.
(5) 
The Town of Bridgeville reserves the right to change commercial user flow data table from time to time, or add or delete user classifications, and, in cases of dispute, to determine the proper classification of a given property.

G. 
Waste haulers:

(2) 
All costs incurred by the Commissioners of Bridgeville in the enforcement and monitoring of the pretreatment program shall be reimbursed by the permittee to the Commissioners.
H. 
For all sewer connections on the sewer line from the Bridgeville Mall Limited Partnership property (now the Bridgeville Plaza Corporation property), there shall be a sewer impact fee of $1,500 per equivalent dwelling unit for any commercial, institutional or industrial structures pursuant to Subsection F above. The sewer impact fee for any residential structure on said sewer line shall be $360 per bedroom. There shall be a minimum sewer charge impact fee of $1,080 for any residential dwelling. The sewer impact fee for any apartments or townhouses on said sewer line shall be $360 per bedroom.

I. 
For all industrial, commercial and non-Bridgeville wastewater service users, there shall be a penalty of $250 per equivalent dwelling unit (EDU) in excess of the agreed-upon allocation.

In addition to existing building permit fees, the building permit fee shall also include a fee of 1 1/2% based on the cost of construction or the projected selling price of the residential property, whichever is greater. This fee shall be collected if settlement involves only the price of the lot.
