The National Fire Protection Association Life Safety Code, NFPA 101, current edition, as published by the National Fire Protection Association is hereby adopted as the Occupancy Code of the Town of Dewey Beach, Sussex County, Delaware for the purpose of establishing rules and regulations for the occupancy of buildings and structures within the Town except such portions as may hereafter be deleted, modified or amended, and the same are hereby adopted and incorporated by reference as if fully set forth herein.
The purpose of this Code is to provide requirements to safeguard life, health and public welfare and the protection of property as it relates to these safeguards by regulatory and controlling the occupancy of buildings and structures.
For the purpose of interpreting this chapter, the "occupancy limit" as determined and posted by the State of Delaware Fire Marshall's office shall be conclusively presumed to be the occupancy limit permitted under this chapter.
At least one copy of the Occupancy Code shall be on file in the Town offices for public inspection and use.
Any owner, lessee or person in a position of control of any building or structure found guilty of violating this chapter shall be fined not less than $200 and not more than $500 for each offense, plus costs. Violations of this chapter shall be treated as a Class C misdemeanor.
