There is established the Town of Dewey Beach Planning Commission.

The Town Planning Commission shall consist of not less than five and not more than seven members to be appointed by the Mayor, subject to confirmation by a majority of the elected members of the Town Commissioners for a term of three years each, provided that if more than three Planning Commission members’ terms of appointment shall expire in any one calendar year, Planning Commissioners shall be appointed for terms of one year or two years as necessary to preserve the staggering of the terms.

The Mayor and Building Inspector shall be ex officio members of the Planning Commission. An ex officio member shall act in an advisory capacity for the Commission, shall have no vote and shall not hold an office on the Planning Commission.
A. 
Any member of the Commission may be removed for cause after a public hearing by the Town Commissioners and with the approval of a majority of the Town Commissioners.
B. 
Vacancies occurring other than by expiration of term shall be filled by a majority of the Town Commissioners.
All members shall serve without compensation but may be reimbursed for actual expenses incurred in connection with their official duties.
The Planning Commission shall elect annually a Chairman and Secretary from among its members and may employ experts, clerks, and such other assistance that its fiscal appropriations shall permit. The Planning Commission may also appoint a custodian of its plan and records who may be the Town Manager.
The Commission shall make its own rules of procedure and determine the times of its meeting. All meeting of the Planning Commission at which any official action is taken shall be open to the public. All records of the Commission shall be a public record.
The Planning Commission shall have the authority:
A. 
Vested in municipal planning commissions by Chapter 7, Title 22, Delaware Code, and shall perform the duties therein set forth whether or not such authority or duties are expressly referred to herein;
B. 
To review and report on suggested amendments to Chapter 185, Zoning, referred to it by the Town Commissioners;
C. 
To recommend to the Town Commissioners revisions to Chapter 185, Zoning; and
D. 
Any other matter referred to it by the Town Commissioners.
