It is the policy of the Town of Elsmere to not allow any person involved in continued violations of the ordinances of the Town of Elsmere to be able to continue activities that are subject to permits or licenses from the Town of Elsmere while those violations are occurring.
Should it appear to the Town Manager that any person holding a permit or license issued by the Town of Elsmere shall have committed any of the acts set forth in § 60-3 of this article, the Town Manager, after providing 30 days' written notice and an opportunity to be heard on why action under this article should not be taken, may revoke the Town of Elsmere license or permit of any such person. The license or permit shall be reinstated upon a showing satisfactory to the Town Manager that the acts complained of leading to the revocation have ceased and any violation of the Town of Elsmere's ordinances have been corrected.
Any of the following reasons are sufficient to warrant revocation of a permit or license issued by the Town of Elsmere:
A. 
The license or permit holder has failed to pay any tax, fee or other amount due to the Town of Elsmere, including, but not limited to, rental permits, property taxes or business licenses;
B. 
The license or permit holder has failed to complete work described in other permits within a reasonable time or in a safe and workmanlike manner; and
C. 
The license or permit holder has failed to correct, within a reasonable time and after notice, any work described in other permits that the Building Official has determined violates the Building Code.
No permit or license shall be issued to any person who is found to have committed any of the acts set forth in § 60-3 of this article until such acts are corrected.
Any determination to revoke a permit or license or to deny issuance of a permit or license shall be appealed to the Board of Adjustment and shall be conducted in accordance with the provisions of § 225-40.
This article shall be effective immediately upon adoption.
