Subject to the justification defenses set forth in Title 11 of the Delaware Code, the firing or discharge of any firearm, air rifle or pistol within the City of New Castle is hereby prohibited. For purposes of this chapter, the following definitions shall apply:
AIR RIFLE OR PISTOL
Any low-powered rifle or hand gun, including but not limited to a BB gun, that uses compressed air or gas to fire small pellets.
FIREARM
Any small arms weapon, such as a rifle or pistol, from which a projectile is fired by gunpowder.
The provisions of this chapter shall not apply to a police constable, police officer or other duly appointed police official while acting in the performance of his duties.

Any person who shall violate the provisions of § 122-1 of this chapter shall be fined not more than $500 for a first offense. Persons who violate the provisions of § 122-1 of this chapter two or more times shall be subject to a fine of up to $1,000 and imprisonment of up to one year for each such subsequent offense.
