The Mayor and Council of New Castle believe that recycling provides numerous benefits to the citizens of New Castle, such as reducing the consumption of nonrenewable sources of energy and raw materials; extending the life of landfills and reducing municipal costs associated with landfill fees; reducing emissions of greenhouse gases; and saving energy. It is thus the intention of this article to establish a recycling program where economically feasible.
The Director of Public Services or his or her designee is directed to establish a yard waste recycling program to recycle yard waste items such as grass clippings, tree trimmings, leaves, disposed Christmas trees, and other such organic material that may, upon the opinion of the Public Services Director, be reasonably recycled.
A. 
From April 1 through October 31 of each year, grass clippings will only be collected on special grass collection pickup days as established by the Director of Public Services.
B. 
Grass clippings left for pickup shall be placed at curbside in cans, containers, or paper bags on the day of the scheduled special grass collection. No can, paper bag or container left for grass collection shall weigh more than 40 pounds per can, bag, or container.
C. 
Grass that is mixed with regular household garbage or trash will not be collected.
D. 
Grass that is left for collection in plastic bags will not be collected.
E. 
Branches will not be collected as part of this program, but will be collected free of charge upon a request made to the Public Services Department at 322-9813.
F. 
Grass collected under the grass collection program shall be mixed with other yard waste collected for the purpose of producing compost at the City's Yard Waste Recycling Area. Compost created as a result of this program will be used by the City for landscaping needs of the City as determined by the Public Services Director.
G. 
When the Public Services Director has determined that a sufficient quantity of compost has been created to fulfill the needs of the City, the excess compost shall be made available for use of City residents under a program established by the Public Services Director.
A. 
City of New Castle residents desiring to dispose of routine branches and tree limbs from their property may request a special pickup from the Public Services Department at any time of the year by calling 322-9813.
B. 
Tree limbs and branches shall not be left out at the curb until the scheduled day of the branch collection pick up.
C. 
No fee will be charged for special pick up under the branch collection program.
D. 
Branches and limbs left for special pick up must be bound in bundles no larger than four feet by two feet, and no limb shall be any larger than eight inches in circumference.
E. 
Material picked under the branch collection program will be made into compost by the City as defined in § 204-13.
A. 
City of New Castle residents may deposit leaves from trees on their property along the curbside for pick up by City personnel from October 1 through November 30 of each year.
B. 
At no other time may residents place leaves at curbside except under the leaf collection program unless a special pick up is requested by calling the Public Services Department at 322-9813.
C. 
No other material such as trash, garbage, rocks, stone, or other unsuitable material shall be placed amongst leaves for pick up under the leaf collection program.
D. 
No fee will be charged for pick up under the leaf collection program.
E. 
Material picked under the leaf collection program will be made into compost by the City as defined in § 204-13.
A. 
City of New Castle residents may deposit their Christmas trees along curbside for pick up by City personnel from December 26 through January 26 of each year.
B. 
Christmas trees longer than eight feet in length must be cut to sections no longer than eight feet in length.
C. 
No fee will be charged for pick up under the Christmas tree collection program.
D. 
Material picked under the Christmas tree collection program will be made into compost by the City as defined in § 204-13.
A. 
Anyone found to be in violation of the Recycling Ordinance will receive a written warning by the Public Works Department which will normally consist of tagging the improper placement of material along curbside.
B. 
Following the issuance of two warnings, any subsequent violation shall be referred to the Code Enforcement Officer for enforcement action.
C. 
Each violation in excess of three shall result in the issuance of a fine of $50.
Individuals may appeal enforcement action to the Board of Building Appeals.
