The following words used in this article shall,
in addition to the usual meaning thereof, include the following meanings:
DUST
Includes any solid substance or particle of any solid substance
of any shape or size, whether mineral or vegetable or combination
thereof, which may be transported from one location to another through
the air by winds or air currents of a velocity of 25 miles per hour
or less.
PERSON
Includes a natural person of either sex, a corporation, partnership
and association, a firm or any other legal entity.
No person shall engage in any activity or operate
any device which shall result in the emission of dust within the City
in quality sufficient to injure the property or business of others
or in quality sufficient to be a detriment to or endanger the health,
comfort and safety of the general public.

The emission of dust in violation of §Â
118-2 of this article is hereby declared to be a public nuisance. Any such nuisance may be abated by the City pursuant to the procedures established in §Â
118-25. Any such abatement may be in addition to the penalties hereinafter provided.
No person shall engage in any activity or operate
any device which will result in the emission of dust within the City
without first taking all reasonable precautions to ensure that the
emission of such dust is reduced to a minimum.
Any person violating any provision of this article shall be guilty of a misdemeanor and upon conviction thereof, shall be punished as provided in Chapter
1, General Provisions, Article
I, General Penalty.
