In order to provide for the proper protection,
order, conduct, public safety, health, welfare and well-being of persons
and property within the City of Breckenridge, the City Council finds
that it would be in the public interest to enact the provisions of
this chapter for the purpose of regulating and controlling the conduct
of all parades conducted upon public streets or highways in the City
of Breckenridge.
As used in this chapter, the following terms
shall have the meanings indicated:
PARADE
Includes but shall not be limited to any organized or any
informal or formal march, procession, festival, display, exhibition,
race, bike-a-thon or other ceremonial formation and march organized
or conducted for any purpose whatsoever intended to be conducted upon,
over or across any public highways or roadways within the City of
Breckenridge.

The City Administrator or his/her designee shall be authorized to issue a parade permit pursuant to §
122-4 for the conduct of a public parade within the City of Breckenridge upon receipt of a completed application therefor upon such application forms as are available from time to time from the office of the City Administrator or his/her designee. All applications for a parade permit shall be filed with the City Administrator or his/her designee at least 21 days prior to the date of the conduct of the parade. Such application shall contain at least the following information:
A. The name and address of the applicant.
B. The name and address of the organization or entity
which is sponsoring or otherwise conducting such parade.
C. The name of the street or streets or roadways within
the City of Breckenridge over which the parade is intended to be conducted,
together with the location of the gathering or commencement point
of the parade and the termination point of the parade.
D. A narrative description of the course of the parade,
including all intersections or other public or private buildings,
parking lots or areas which may be temporarily blocked or obstructed
during the conduct of the parade.
E. The hours of the commencement and anticipated termination
or completion of the parade.
F. The name, address and phone number of the insurance
agency or company issuing or providing insurance coverage for the
conduct of the parade.
G. Such other or further information as the City Council
may reasonably require and prescribe by resolution from time to time.

The permit application shall be reviewed by
the City Administrator or his/her designee, Chief of Police, Street
Foreman and other interested City officials and may be denied if,
in the opinion of the Chief of Police the conduct of the parade along
the streets or highways or portions thereof on the date requested
would unduly interfere with the flow of vehicular traffic or would
otherwise be such so as to hinder or unduly interfere with the proper
protection, safety, health, welfare and well-being of the citizens
of the City of Breckenridge. In the event of the denial of the permit,
the City Administrator or his/her designee shall advise the applicant,
in writing, of the reason or reasons of the denial of the application.
In the event that the applicant is denied a permit, the applicant
may appeal the ruling to the City Council.
Any permit issued pursuant to the provisions
of this chapter shall be valid only for the date and hours specified
thereon and for no other date or times whatsoever.
The applicant shall be responsible for removal
of all litter, debris and other material from the streets or highways
upon which the parade was conducted and shall provide for such cleanup
immediately upon completion of the conduct of the parade.
Any parade conducted pursuant to a permit issued
pursuant to the terms of this chapter shall be conducted so as not
to obstruct any roadways, highways or public or private entrances
such that emergency and hazard vehicles may pass in response to any
emergency.
Any person, firm or corporation who shall violate any provision of this chapter shall be guilty of misdemeanor and, upon conviction thereof, be punished as provided in Chapter
1, General Provisions, Article
I, General Penalty.
