It is recognized by the Board of County Commissioners that the Atlantic County Division of Public Health conducts inspections both as a requirement of law and by request in order that the requesting party may obtain approval to transfer title to the property and not as a result of any mandate of law on the part of the Division of Public Health. Accordingly, in order that the Division of Public Health shall receive adequate reimbursement for such inspection services, the following fee schedule is hereby established by ordinance.
As used in this article, the following terms shall have the meanings indicated:
DIVISION
The Atlantic County Division of Public Health.
EXISTING CONSTRUCTION
Includes all buildings and structures used for private or commercial purposes which have previously been constructed and have previously received approvals for existing individual sewage disposal systems. For the purpose of this definition, buildings or structures that have been renovated shall be considered as existing structures.
INDIVIDUAL SEWAGE DISPOSAL SYSTEM
A system for the disposal of sanitary sewage into the ground, which is so designed and constructed to treat sewage in a manner that will retain most of the settleable solids in a septic tank and discharge the liquid portion to an adequate disposal field.
NEW CONSTRUCTION
All buildings and structures used for private or commercial purposes that are either under construction or have been recently completed.

The Division shall charge a fee as indicated in Ch. 73, Fees, Art. VII, Atlantic County Division of Public Health Services, whenever, by request or by operation of law, the Division witnesses a percolation test and soil boring for the proper design of an individual sewage disposal system in new construction.

Fees shall be charged as indicated in Ch. 73, Fees, Art. VII, Atlantic County Division of Public Health Services.

Whenever the Division, by request or by operation of law, for approval of a sale of the premises, performs an inspection in order to ascertain that a septic system in existing construction is functioning in accordance with applicable state and county codes and regulations, a fee shall be charged as indicated in Ch. 73, Fees, Art. VII, Atlantic County Division of Public Health Services.

All requests for inspection of individual sewage disposal systems shall be made to the Division by 9:30 a.m. in order for a same-day inspection to be completed. Payment as specified in § 116-5 above shall be made contemporaneously with the request.
