As used in this article, the following terms shall have the meanings indicated:
DIVISION
The Atlantic County Division of Public Health.
EXISTING CONSTRUCTION
Includes all buildings and structures used for private residential or commercial purposes which have previously been constructed and have previously received approvals for existing individual sewage disposal systems. For the purpose of this definition, buildings or structures that have been renovated shall be considered existing structures.
INDIVIDUAL SEWAGE DISPOSAL SYSTEM
A system for the disposal of sanitary sewage into the ground, which is so designed and constructed to treat sewage in a manner that will retain most of the settleable solids in a septic tank and to discharge the liquid portion to an adequate disposal field.
NEW CONSTRUCTION
All buildings and structures requiring a building permit used for private residential or commercial purposes, which are either under construction or have recently been completed but have not yet had a certificate of occupancy issued, and which are not served by an approved sewerage system, the useful occupancy of which will require the installation or erection of sewerage facilities.
SEWAGE HOLDING TANK
A watertight receptacle which receives the discharge of sewage from a building sewer or part thereof.
Any application submitted to the Division pursuant to the Realty Improvement Sewerage and Facilities Act, N.J.S.A. 58:11-23 and the Standards for Construction of Individual Subsurface Sewage Disposal Systems, N.J.A.C. 7:9-2.1 et seq., shall be disapproved by the Division unless exempted pursuant to § 116-9.
A. 
The Division shall have the authority to issue a permit for the repair or replacement of existing sewage holding tanks installed prior to 1977 and existing sewage holding tanks installed during or after 1977 which were previously approved by the Division.
B. 
The Division shall have the authority to issue a permit for use of a holding tank for existing structures serviced by individual sewage disposal systems if the individual sewage disposal system is no longer functioning properly and poses a threat to the public health and if the physical characteristics of the property make it impossible to have a new standard or alternative individual sewage disposal system installed in accordance with the guidelines set forth in N.J.A.C. 7:9-2.1 et seq. or to have the property connected to a sanitary sewer system.
C. 
The Division shall have the authority to issue emergency permits for temporary use of a holding tank, subject to conditions prescribed by the Division to protect the public health, in the case of failing or destroyed individual sewage disposal systems which may be repaired or replaced in accordance with N.J.A.C. 7:9-2.1 et seq. Emergency permits may be issued for a period of 30 days and may be renewed for a maximum of five additional thirty-day periods.
