A. 
The following fees shall be charged for the use of the municipal boat ramp:
(1) 
Daily ramp pass. A fee of $20 shall be charged for any person to use the municipal boat ramp for a particular boat on a particular day. Any person wishing to use the municipal boat ramp for more than one boat shall pay an additional fee of $20 for each additional boat.
(2) 
Season ramp pass. A fee of $120 shall be paid for the issuance of a seasonal ramp pass. The owner of a seasonal ramp pass shall be entitled to use the municipal boat ramp during the entire season (April 1 through December 1) without additional charge for one particular boat which he or she owns.
(3) 
Commercial ramp pass. A fee of $200 shall be paid for the issuance of a commercial ramp pass. A commercial ramp pass shall permit its owner to utilize the municipal boat ramp on an unlimited basis without the payment of any additional fees to the Borough of Barnegat Light. A commercial ramp pass shall only be issued to an individual, partnership, company or corporation that owns and operates a marina or engages in the buying, selling, delivery or transfer of boats.
B. 
Fee exemption. The boat ramp fees provided by this section shall not apply to any permittee or lessee of a municipal boat slip or livery regarding the necessary occasional use of the municipal boat ramp for his or her boat(s) duly registered with the Borough in accordance therewith.
C. 
Late fee for boat ramp pass. In the event any person uses the municipal boat ramp without first having obtained a ramp pass, a late boat ramp pass fee will be charged in the amount of double the daily ramp pass fee, if not paid within 30 days of being notified by the Borough. This late ramp pass fee will increase by an additional daily ramp pass fee rate for each additional 30 days or part thereof that the late ramp pass fees remain unpaid. The late boat ramp pass fees shall be in addition to any fines and penalties assessed by the Barnegat Light Municipal Court.

A. 
No person shall use or occupy or allow or suffer the use or occupancy of a municipal boat slip unless and until a permit for that purpose has been duly obtained from the Borough of Barnegat Light. No person shall use or occupy a municipal boat slip after the expiration of a duly issued boat slip permit. Under no circumstance shall a permittee allow or suffer a boat other than the permitted boat to use or occupy the permitted boat slip.
B. 
Only one permit shall be issued at a time for each municipal boat slip available for use. Permits shall be issued on a first-come-first-served basis.
C. 
Boat slip permits shall not be assignable or transferable. Only the specific permitted boat shall be allowed to occupy the boat slip. Any change in the identity of the permittee or ownership of the permitted boat shall require a new application for a boat slip permit. Any change in the permitted boat shall require a new application for a boat slip permit.

Any person desiring to obtain a permit to dock at and use a municipal boat slip may do so by applying for a boat slip permit from the Borough of Barnegat Light. Applications will be accepted any time from January 1 through December 1 for each year. The application shall set forth the applicant's full name, residence address, business address, driver's license number, boat license number, boat registration number, residence and business telephone numbers and an emergency telephone number. The applicant/permittee shall also be required to sign an acknowledgement regarding all of the terms and conditions of the permit, as set forth in this article. The applicant/permittee shall keep all of the foregoing information current with the Borough. Payment in full of the boat slip permit fee must be made at the time that the application is submitted for consideration. In addition to the foregoing, the applicant shall supply the Borough with a $100,000 liability insurance policy naming the Borough as an additional named insured party. The applicant shall also supply any other information reasonably requested by the Borough Dock Master and/or his assistants.

A. 
The following fees shall be charged for a permit for the use of the municipal boat slips:
(1) 
Seasonal boat slip permit. A fee of $2,500 shall be charged for a permit for the use of one municipal boat slip for the entire season (April 1 through December 1 annually, or until vacated, whichever is sooner).
(2) 
Weekly and weekend boat slip permits, if available, may be issued at the discretion of the Borough. A fee of $125 per week (Saturday through Saturday, or any portion thereof), shall be charged for the use of one municipal boat slip for one week.
(3) 
A daily fee of $30 per day shall be charged for the use of one municipal boat slip, if available, during April 1 through December 1.
B. 
Permit renewal fee. Any application to renew a boat slip permit must be made and approved prior to January 1 of each year. The Borough reserves the right to withhold any boat slip from being offered for a new or renewal permit.
C. 
Refund of permit fee. There shall be no refund of any permit fee or portion thereof for any reason whatsoever once the boat slip permit fee has been deposited by the Borough. In the event a permittee has unusual and extraordinary circumstances, the Borough may, in its sole discretion, allow a permittee to terminate the permit prior to the end of the season. Upon vacation of the boat slip, the Borough may repermit the slip on a prorated seasonal, weekly or weekend basis. The Borough shall charge a $100 processing fee for any request to terminate a permit prior to the end of the season, at which time the Borough may return all or part of the remaining prorated permit fee to the original permit holder, in the Borough's sole discretion.

All boat slip permits issued by the Borough of Barnegat Light shall be subject to the following terms and conditions:
A. 
Boat slips 1 through 33, inclusive, shall be limited in size to boats with a maximum LOA actual length of 25 feet overall and width of eight feet. No other type of watercraft will be permitted. Sailboats, Jet Skis, Waverunners, kayaks, canoes, and personal watercraft of any other kind are prohibited.
B. 
Boat slips 34 through 45, inclusive, shall be limited in size to motor boats with a maximum LOA actual length of 27 feet and width of eight feet. No other type of watercraft will be permitted. Sailboats, Jet Skis, Waverunners, kayaks, canoes, and personal watercraft of any other kind are prohibited.
C. 
Boat slips shall not be merged with any adjoining slip to create one larger slip area.
D. 
The use of the boat slip shall only be for the use of the permitted and registered boat for personal recreational purposes. No other use shall be permitted thereon, nor shall the storage of any boats, commercial or otherwise, lockers or equipment be permitted in the upland or parking area. Under no circumstance shall a permittee allow or suffer a boat other than the permitted boat to use or occupy the permitted boat slip.
E. 
The Borough has the right to inspect the boat slips, permitted boats, any boats in the municipal slips, buildings, equipment, parking facilities or other facilities at the municipal docks at any reasonable time. The Borough reserves the right to repair or improve the floating docks, bulkhead or other facilities on the subject premises during the term of the boat slip permit, and the Borough shall not be responsible or liable for any damages or permit fee abatement.
F. 
The permittee shall indemnify and save the Borough harmless from and against all claims, losses and liabilities and all lawsuits, including all costs and expenses and attorney fees, for or on account of any property damage, injuries or death to any person, firm or corporation caused by the negligence of the permittee, his agents, servants or employees or in the doing of any act whatsoever related to the subject boat slip permit. Any powers or authority not expressly conferred upon the permittee shall be deemed reserved to the Borough.
G. 
The Borough will not be responsible for any loss or damage of mooring, tackle, ropes or hardware or any other equipment of the permittee.
H. 
The permittee shall maintain the boat slip area free from refuse, including but not limited to clam shells and fish remains and similar debris, at the permittee's own expense. No such waste shall be deposited in any waterway.
I. 
The permittee shall take all reasonable measures to conserve the use of fresh water at municipal docks, including the use of watersaver nozzles on all hoses connected to the public water supply.
J. 
The permittee shall not improve, change, alter or install any equipment upon the permitted area. Slips are permitted on as as-is basis, and modifications shall not be made to docks, bulkheads or fingers during the permit term.
K. 
Any Borough approved modifications made to any slip requested by the permittee shall be made by the Borough's employees, and the materials and labor costs will be charged to the permittee.
L. 
The Borough Dock Master or his representative may board any vessel at the municipal docks for any reason, at the discretion of the Dock Master. If a permitted boat sinks or takes on water, the Borough Dock Master will attempt to notify the permittee at the emergency telephone number(s) provided. In the event that the permittee does not raise or pump a sunken or partially sunken boat within 24 hours of the Dock Master's attempted telephone call, regardless of whether the permittee has been reached or not, the Borough may have the boat removed at the permittee's expense. Boats leaking fuel, gas, oil or any other hazardous substance will be removed immediately, at the permittee's expense.
M. 
If the permittee shall violate or allow or suffer the violation of any of the foregoing conditions or any of the provisions of this article, the boat slip permit shall be immediately terminated, and the Borough shall immediately take possession of the boat slip. In the event that a boat must be removed from a boat slip in order for the Borough to take possession of the same, the permittee shall be responsible for all costs and expenses of the Borough associated with the removal of the same.
N. 
The Borough reserves the right to establish and implement any other reasonable and necessary rules and regulations concerning the use of and activities at the municipal boat slips.

Any violation of this article shall be punishable as provided in § 1-15 of the Borough Code, entitled "Violations and penalties." Any violation of this article shall also result in the immediate termination of any ramp pass or slip permit issued by the Borough.

A. 
Any person desiring to moor and/or use the Borough's bayfront area for any boat, kayak or personal watercraft (nonmotorized) of any kind may do so only after registering said vessel with the Borough of Barnegat Light. There shall be a registration fee of $10 for the same. The registration application shall set forth a description of the vessel, the owner's full name, residence address, business address, driver's license number, boat license number (if applicable), boat state registration number (if applicable), residence and business telephone numbers and an emergency telephone number. The owner shall keep all of the foregoing information current with the Borough. The applicant shall also supply any other information reasonably requested by the Borough Dock Master and/or his assistants.
B. 
The use of the Borough's bayfront area shall be limited to 10th to 12th Streets, and 24th to 30th Streets, along the bay. The bayfront shall not be used for any such mooring or bay access in the off-season from December 1 to April 1.
C. 
The Borough will not be responsible for any loss or damage of mooring, tackle, ropes or hardware or any other equipment of the registrant.
D. 
The registrant shall not change, alter or install any equipment upon the mooring area.
E. 
If the registrant shall violate any of the foregoing conditions or any of the provisions of this article, the registration shall be immediately terminated. In the event that a registered vessel must be removed, the registrant shall be responsible for all costs and expenses of the Borough associated with the removal of the same.
