A code establishing fire prevention regulations for the protection of
the public health, safety and welfare is hereby established. A copy of said
code is annexed hereto and made a part hereof without the inclusion of the
text herein.
Said code established and adopted by this article is commonly known
as the "BOCA Basic Fire Prevention Code/1978, Fourth Edition."
Three copies of said BOCA Basic Fire Prevention Code/1978, Fourth Edition,
have been placed on file with the office of the Borough Clerk of the Borough
of Barnegat Light upon the introduction of this article and will remain on
file there until final action is taken on this article for the use and final
inspection of the public.
Notwithstanding the provisions of Section F-104.0 of said code herein,
any person affected by the code herein adopted may appeal to the Mayor and
Council of the Borough of Barnegat Light, which shall have the power to hear
such matters, to interpret the code herein adopted and to decide the matter
in accordance with the objectives of the code and the laws of the State of
New Jersey, provided that no relief shall be granted hereunder unless such
relief can be granted without substantial detriment to the public good and
without substantial impairment to the intent and purpose of the code herein
adopted.
Notwithstanding the provisions of Section F-105.5.1 of the code adopted
herein:
A.
Any person or persons, firm or corporation violating or neglecting to comply with any provision of this article or the BOCA Basic Fire Prevention Code/1978, Fourth Edition, made a part hereof or notice issued pursuant thereto shall be punishable as provided in Chapter 1, General Provisions, § 1-15.[1]
B.
Each day a particular violation continues shall constitute
a separate offense.
When by reason of exceptional circumstances the strict application of
any provision included in the code herein adopted would result in peculiar
and exceptional difficulties to or hardship upon the owner or occupant of
the property affected or when the application of the code in a particular
case requires interpretation or explanation or where it is contended that
the enforcement officer is in error in the application thereof, any person
affected by the code herein adopted may appeal to the Mayor and Council of
the Borough of Barnegat Light as stated herein.

Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c.
383),[1] the New Jersey Uniform Fire Code shall be locally enforced in
the municipality.

The local enforcing agency shall be the Ocean County Bureau of Fire
Safety under the supervision of the Ocean County Fire Marshal.
The Ocean County Bureau of Fire Safety shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the municipality
other than owner-occupied one- and two-family dwellings and shall comply with
the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The Ocean County Bureau of Fire Safety shall carry out the periodic
inspections of life hazard uses required by the Uniform Fire Code.
The Ocean County Bureau of Fire Safety shall be in the Office of the
Ocean County Fire Marshal and shall be under the direct supervision and control
of the Ocean County Fire Marshal, who shall serve as the Fire Official. The
Ocean County Bureau of Fire Safety shall consist of said Fire Official and
such other inspectors and employees as may be necessary to enforce said code,
being appointed by the Ocean County Board of Chosen Freeholders pursuant to
the procedures set forth herein.
A.
Fire Official. The Ocean County Bureau of Fire Safety
shall be under the supervision of the Ocean County Fire Marshal, who shall
be appointed by the Ocean County Board of Chosen Freeholders.
B.
Inspectors and employees. Such inspectors and other employees
as may be necessary for the Ocean County Bureau of Fire Safety to properly
carry out its responsibilities shall be appointed by the Ocean County Board
of Chosen Freeholders.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by a ruling, action, notice or order of the
Ocean County Bureau of Fire Safety shall have the right of appeal to the Construction
Board of Appeals of the County of Ocean.
