No person shall place, discharge or deposit by any process or in any
manner any offal, food, paper, wood, chemicals, oils, gases or any waste material
in any slip, basin, bay, lagoon, river, stream, channel or other waters in
or adjacent to this borough.
A.
No person shall permit or suffer any boat on which one
or more persons stay to be tied up, docked or kept at his premises if:
(1)
Any waste material is or shall be discharged from the
boat or by its occupant into or upon any of the waters of this borough.
(2)
Any condition is caused by the maintenance of the boat
at the location which is either dangerous to the health or interferes with
the comfort of any human being residing or being in the vicinity.
B.
No person shall discharge or suffer or permit the discharge
of any excrement, waste, debris, refuse, chemical or any other matter or material
by any means into or upon any of the waters of or adjacent to this borough
from any boat afloat on the waters which excrement, waste, debris, refuse,
chemical, material or other matter shall or may tend to pollute the waters
or to harm or destroy the fish therein or the wildlife thereupon or to litter
the waters or the shores or banks adjacent thereto.
While in those portions of the Atlantic Ocean or Barnegat Bay or any
other waters that lie within the jurisdiction of the borough, no person shall:
A.
Make any loud noise, sound or music to the annoyance
of any other person.
B.
Ride or operate a boat, float, surfboard or other aquatic
equipment which will endanger any other person or interfere with the enjoyment
of the quiet use of the water by any other person.
C.
Take or consume any alcoholic beverages in the water.
E.
Molest or disturb any person in the peaceful enjoyment
of any bathing facilities.
F.
Do anything which shall endanger the life or safety of
himself, herself or any other person.
G.
Go out in water farther than directed by authorized lifeguards
or police officer.
H.
Refuse or neglect to obey the orders and directions of
authorized lifeguards as to time, place or distances for bathing.
I.
Use, permit or aid in the use of water skis, boats or
personal watercraft in any bathing area. Nothing herein shall apply to a lifesaving
boat or boats in an emergency situation.

No person shall operate a motorized boat, ship or vessel of any kind,
nor shall any person operate any other type of motorized device such as, but
not limited to, personal watercraft, within or on Twilight Lake in the Borough
of Bay Head.

A.
Unless otherwise specified herein, for a violation of
any provision of this article, the maximum penalty, upon conviction thereof,
shall be a fine not exceeding $1,000 or imprisonment for up to 90 days or
a period of community service not exceeding 90 days, or any combination thereof.
Except as otherwise provided, each and every day in which a violation of any
provision of this article exists shall constitute a separate violation.
B.
All fines and penalties under this article may be paid
directly to the Municipal Court Administrator, unless otherwise indicated
by the officer issuing the summons.
