As used in this article, the following terms shall have the meanings indicated:
MIGRATORY WATERFOWL
Includes those species of birds commonly known as swans, geese and ducks, and any other waterfowl falling under the jurisdiction of the United States Fish and Wildlife Service.
It shall be unlawful for any person to feed any migratory waterfowl in Cooper Pond Park in the Borough of Bergenfield.
A. 
This article shall be enforced by the Health Officer, Police Department and the Supervisor of Parks of the Borough of Bergenfield.
B. 
Whenever the Health Officer, Police Department or Supervisor of Parks become aware that migratory waterfowl are being fed in violation of this article, they may issue a summons which shall be answerable before the Municipal Judge.
Any person who is guilty of feeding migratory waterfowl may be punished by a fine up to $100 and shall serve five hours of community service for the first offense and for a second and all subsequent offenses the fine shall be $150 per offense and 10 hours of community service.
