[Adopted 12-16-1975 by Ord. No. 1046 as Sec. 3-17 of the Revised General Ordinances]
As used in this article, the following terms shall have the meanings indicated:
MAGAZINES
Includes bound periodicals printed on glossy coated paper.
USED NEWSPAPERS
Includes paper of the type commonly referred to as newsprint and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Included in this definition are advertising circulars printed on newsprint. Excluded from this definition is used newspaper which has been utilized for purposes other than reading and which has become soiled.
All owners, lessees or occupants of dwelling units shall be required, from December 17, 1974, to separate from their solid wastes or trash all newspapers and magazines which shall be picked up and disposed of separately by employees or agents of the Borough, or by authorized designees. Such separation shall be in accordance with the following terms and conditions:

All newspapers shall be bundled separately with twine or other secure arrangements to ensure that they shall not be capable of being windblown or distributed on the public streets, and provided further that the maximum weight of any bundle shall not exceed 30 pounds, approximately 12 inches high.
B. 
All magazines shall be bundled separately with twine or other secure arrangements to ensure that they shall not be capable of being windblown or distributed on the public streets, and provided further that the maximum weight of any bundle shall not exceed 30 pounds, approximately 12 inches high.
A. 
Bundles of newspapers and magazines as described in the sections above shall be placed at curbside by the owner, lessee or occupant of a dwelling unit on the day of the week or month designated by the Borough Administrator as pickup day for newspapers and magazines in the particular section of the Borough in which the dwelling unit is located. In the case of apartment houses, the owner or manager of such multiple-family dwelling unit shall ensure that a special place within the building or an enclosed place outside of the building which affords protection from the elements is designated for the storage of magazines and newspapers. Under emergency conditions, the time and place for pickup as otherwise prescribed by §§ 266-3 and 266-4 may be varied by pronouncement from the Borough Administrator of the Borough with notice to the residents given by whatever means are deemed appropriate.

B. 
All lessees of the apartment building shall be required to separate newspapers and magazines and place them in the designated place. The owner or manager of the apartment building or multiple-family dwelling unit shall notify the Superintendent of Public Works of the location of such area for storage of newspapers and magazines and shall also notify the Fire Department in order that proper fire safety precautions can be taken. The owner or manager of the apartment building shall not permit or suffer unwarranted accumulations of newspapers or magazines in the storage area which might, in the opinion of the Fire Department, create a fire hazard but shall arrange to have the bundled papers placed at curbside on the designated day of collection aforesaid.
C. 
Placement of bundles of newspapers or magazines shall not be made at the curb later than 6:00 a.m. on the date of pickup.

A. 
Collection from curbside of such bundles of newspapers and magazines shall be made by Borough employees or by contract for outside services or by authorized designees as directed by the Mayor and Council of the Borough with primary administrative supervision being under the control of the Superintendent of the Department of Public Works, subject to the approval of the Borough.
B. 
Nothing in this section shall be deemed to prohibit any owner, lessee or occupant from disposing of newspapers and magazines privately through sale or gift of the person concerned, provided that in no event shall such newspapers and magazines be left at the curb for any private pickup, and further provided that in no event shall any newspapers or magazines be disposed of as part of the solid waste pickup by the Borough in accordance with the normal pickup by the Borough.
From the time of placement at the curb by any person of used newspapers and magazines for collection by the Borough pursuant to the rules and regulations established hereunder, such used newspapers and magazines shall be and become the property of the Borough, or the property of such organization as heretofore defined designated by the Mayor and Council to pick up such newspapers and magazines. It shall be a violation of the provisions of this article for any person unauthorized by the Mayor and Borough Council to collect or pick up or cause to be picked up any such used newspapers and magazines for any purpose whatsoever once same has been placed at the curb since private disposal thereof must be done in accordance with the terms of § 266-3. Any and each such collection in violation hereof from one or more premises shall constitute a separate and distinct offense punishable as hereinafter provided.
The Superintendent of the Department of Public Works with the approval of the Administrator is authorized from time to time by bid or by contract approved by the Mayor and Council to sell and deliver the newspapers and magazines so collected in order to obtain the best possible price therefor depending upon market conditions at the time of sale; provided that service organizations located in the Borough and organized for nonprofit purposes and any eleemosynary organization may be authorized by the Mayor and Council to collect newspapers and magazines and upon collection to dispose of them as it sees fit in furtherance of their civic or charitable objectives.
A. 
Any person violating the provisions of § 266-3 or § 266-5 shall be liable to a maximum penalty at the discretion of the Judge of the Municipal Court of $100 for the first offense and up to $500 or 10 days in jail for each and every subsequent offense.

B. 
Any persons violating the provisions of § 266-6 shall be liable, upon conviction, to penalties set forth in Chapter 1, Article II, General Penalty.
