Article XIII Tobacco Sales and Vending

As used in this article, the following terms shall have the meanings indicated:

Any product made from the tobacco plant for the purpose of smoking, chewing, inhaling and other personal use including cigars, chewing tobacco, pipe tobacco, snuff and cigarettes in any form.

VENDING MACHINE

Any automated, self-service device which, upon insertion of money, tokens or any other form of payment, dispenses cigarettes or other tobacco products.

§ 344-75 Sale of tobacco through vending machine prohibited.

It shall be unlawful to offer for sale or to sell tobacco through a mechanical vending machine with or without locking devices in the Borough of Bergenfield.

§ 344-76 Self-service vending displays.

It shall be unlawful to offer for sale or to sell tobacco from a self-service vending display in the Borough of Bergenfield excluding the sale of cartons of cigarettes.

§ 344-77 Removal of noncompliant machines and displays.

All mechanical vending machines and self-service displays made unlawful by the terms of this chapter shall be removed within 30 days from the effective date of this chapter.
