The placing of any abandoned or unattended icebox, refrigerator or container
of any kind which has an airtight door or the substantial equivalent thereof,
and/or a lock which cannot be released for opening from inside of such icebox,
refrigerator or container, has been and is hereby determined to be a serious
hazard and detrimental to the public health, safety and welfare of the inhabitants
of the Borough of Berlin, and particularly to children.
Pursuant to the provisions of N.J.S.A. 40:48-1 et seq., as amended and
supplemented, it shall be unlawful to place or permit the placing outside
of any building and/or dwelling in a place accessible to children or any person,
any abandoned unused or unattended icebox, refrigerator or other container
of any kind or character which has a substantially airtight door or a lock
of any kind which cannot be released for opening, and opened, from the inside
of such box, refrigerator or container. The placing or permitting to be placed,
the maintenance or the permitting to be maintained, of any such icebox, refrigerator
or container be and it is hereby prohibited from and after the adoption of
this chapter.
Any person violating the terms of this chapter or refusing or neglecting
to comply with any of the provisions hereof shall upon conviction therefor
be subject to a fine of not more than $200 or imprisonment in the County Jail
of the County of Camden for a period of not more than 90 days, or both, in
the discretion of the Magistrate before whom such conviction is had.
