A code regulating the creation or maintenance of standing or flooding
waters; declaring and defining such conditions as unsanitary conditions and
nuisances; and declaring and fixing penalties for violations is hereby adopted
pursuant to N.J.S.A. 26:3-64 et seq.
No person shall create or maintain conditions under which water is permitted
to flood floors, flow across working or walking areas or accumulate anywhere
in such manner so as to create unsanitary conditions or nuisances.
As used in this chapter only, the following terms shall have the following
meanings.
NUISANCES
Conditions which, due to their potential to cause an accident involving
a member of the public, are or have the potential to be injurious to the health
of any member of the public.
PERSON
Any individual, partnership, corporation (both profit and not-for-profit)
or governmental body.
UNSANITARY CONDITIONS
Conditions which, due to their potential to cause the growth or spread
of disease or illness, are or have the potential to be injurious to the health
of any member of the public.
Any person who shall violate any provisions of this chapter shall, upon
conviction, be punished by fine not less than $5 nor more than $500, and each
violation of any of the provisions of this chapter and each day the same is
violated shall be deemed and taken to be a separate and distinct offense.
