As used in this chapter, the following terms shall have the meanings indicated:
COLLECTION DATES
Those dates set by the Director of the Department of Public Works, or his designee, for the collection of leaves.
LEAVES
Any flattened plant structures which were attached to a stem and functioned as a principal organ of photosynthesis. Leaves shall not include any grass clippings, shrubbery, branches or root material.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines.
A. 
All leaves are to be placed in paper biodegradable bags which have a minimum capacity of 15 gallons. Leaves shall not be placed for collection in plastic bags, trash cans, buckets or other types of bags.
B. 
Grass clippings, shrubbery, branches, root material or any other materials shall not be mixed with biodegradable bagged leaves.
Leaves accumulated by residents of the Township of Bridgewater shall be collected on a schedule to be established by the Director of the Department of Public Works. Such schedule may be altered or amended from time to time to conform to legal holidays and emergencies or as deemed necessary by the Director.
A. 
All leaves subject to the collection schedule and to disposal by the Township of Bridgewater shall be placed in the paper biodegradable bag required hereby and set out within two feet of the curbline adjacent to the property from which the leaves originated.
B. 
Subject to § 82-6, biodegradable paper bags of leaves, as described above, shall not be placed at the curb earlier than the evening before the day of collection.
C. 
Subject to § 82-6, no person shall cast, place, sweep or deposit leaves anywhere in the Township of Bridgewater in such a manner that they may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, drainage, waterways or other private or public place or into any premises within the Township of Bridgewater.
The Director of Public Works, or his designee, may refuse to collect any leaves which fail to meet the regulations set forth herein. In such event, the person placing the refuse for collection shall be compelled to dispose of the same at their own cost and expense within one week (or sooner if the failure to dispose of the refuse in a timely manner poses a threat to the health, safety and/or welfare of the residents) of such refusal by the Director or his designee.
Placement of such leaves at the curb or along the street at any other time or in any other manner is a violation of this chapter. If such placement of leaves occurs, the party responsible for placement of the leaves must remove the leaves from the street or said property shall be deemed in violation of this chapter.
The provisions of this chapter shall be enforced by the Department of Public Works, the Health Officer, the Department of Code Enforcement and/or the Bridgewater Township Police Department.
Any person(s) who is found to be in violation of the provisions of this chapter shall be subject to a fine not to exceed $1,000.
