This chapter shall be known and may be cited as the "City of Auburn Streets and Public Places Ordinance."
A. 
Permit required. No person shall place, or cause to be placed, any building material, scaffolding, barricades, roll-off trash containers and the like in or upon any portion of any public street, sidewalk, bridge, alley or public place unless he or she shall first have obtained a permit therefor from the Office of the Code Enforcement for such use of a portion of the public street. Such permit shall state the portion of the street that may be so used and the period of time such material may remain therein, together with such other conditions and provisions as the Office of the Code Enforcement may deem advisable.

B. 
Barriers and warning devices to be erected. Any person so occupying a portion of any public street, sidewalk, bridge, alley or public place with building material shall, at all times, erect a good and sufficient barrier around such materials and, during the nighttime, place a sufficient number of warning lights or devices to be kept burning during the night to advise of the location of such material.
C. 
Walkway to be provided. Any person to whom any such permit is granted shall immediately construct a sufficient walk for street passengers of board or planks or other material around such obstacle so as to allow a safe and convenient passage for pedestrians.
D. 
Restoration of street or sidewalk. Every person so occupying a portion of such street with building material shall, at the termination of such permit, unless the same is renewed, immediately remove all material from such street and restore the street and sidewalk where such material was stored to a reasonably safe condition for public travel acceptable to the Superintendent of Engineering Services.
No person shall move, or cause or suffer to be moved, any building into, along, upon or through any street or highway without first having obtained a permit therefor from the Superintendent of Engineering Services, and no such building shall be allowed to remain in any highway for a longer period than that limited or specified in such permit.
A. 
Materials. No awning shall be placed or constructed over any sidewalk unless the same is made of cloth or canvas and is properly supported; provided, however, that awnings of other materials may be placed or constructed over sidewalks if they are of a material and type of construction approved by the Building Inspector and installed in a manner approved by him or her.
B. 
Clearance. Every part of such awning and the supports thereof shall be at least seven feet above the sidewalk, except that the Building Inspector may require further clearance if necessary.
The owner or occupant of every building fronting upon or in close proximity to the line of any sidewalk, street, highway or traveled place shall remove, or cause to be removed, the snow and ice from the roof of such building, when the same is liable to fall therefrom. Such removal shall be done at such times and in such manner as not unnecessarily to hinder or delay travel and so as not to subject persons or animals traveling upon such highway to risk or danger.

A. 
Responsibility. The owner, occupant or lessee of any lot or lands adjoining any public sidewalk shall keep the same free from snow, slush or ice. In case of failure or neglect to comply with this requirement within 24 hours following any storm depositing such snow, slush or ice, such may be removed by City staff at the direction of the City Manager. Failure to complete such removal shall not be deemed an act of negligence by the City of Auburn.
B. 
Cindering or sanding. In the event that snow, slush or ice may become frozen on sidewalks in such a way that removal is difficult or injurious to sidewalks, the sidewalks shall be rendered safe for public travel by use of cinders, sand or other suitable materials and shall be properly cleaned thereafter when weather permits. If any owner, occupant or lessee of lots or lands abutting sidewalks fails to comply with this requirement, the walks shall be rendered safe by City staff and thereafter cleaned at the direction of the City Manager.
C. 
Work performed by City staff. Any work performed by City staff pursuant to this section shall be charged against the property owner and shall be billed and collected by the City Treasurer. Such charge shall be a lien on the adjoining realty to the same extent as City taxes and may be included in the general City tax roll and enforced in the same manner as other City taxes. The cost, established at least annually by the City Council through a budget resolution that adopts a City fee schedule, of removal plus an administrative and supervisory expense of 50% thereof, shall be charged.
No person shall place, hang out or suspend, or suffer to be placed, hung out or suspended, any goods, wares or merchandise of any sort in any street in front of his or her building, or place of business, at a greater distance therefrom than three feet.
A. 
Generally. No person shall deposit, place or put, or suffer to be deposited, placed or put, any goods, wares or merchandise, or any chattel, on any sidewalk in front of his or her building or lot, except while actually removing the same into or from such building.
B. 
Exception. The City Manager may permit the display and placing of goods, wares and merchandise on special occasions or promotions under such terms and conditions as will reasonably safeguard the public.
No person shall fly a kite, play ball, throw any stone or missile, or use or discharge any air gun or slingshot, or use any device for throwing stones or shot, or roll or tumble a hoop on, in or upon any sidewalk or street.
A. 
Council may designate. No person shall coast, slide or ride upon any sled or similar contrivance on any sidewalk or street, except upon those streets or parts thereof as the Council designates.
B. 
Hours. Use of streets set aside and used for coasting shall be limited to the following hours: 4:00 p.m. to 9:00 p.m. on school days; 2:00 p.m. to 9:00 p.m. on Sundays; and 9:00 a.m. to 9:00 p.m. on Saturdays and holidays.
C. 
Responsibility of Recreation Department. The Recreation Department shall assume all responsibility for placing barricades and warning lights and for cindering at the foot of all grades.
No person shall deposit, place, or throw, or permit to be deposited, placed or thrown, any ashes, leaves, papers, letters, cards, dodgers, glass, nails, or other matter into or upon any street, sidewalk, highway, traveled road or lane, or place in such street, except that boxes, barrels or other receptacles containing such things may be deposited for collection. No person shall throw or deposit the peelings of any bananas, oranges, lemons or other fruits upon any sidewalks or crosswalks, except that ashes or sand may be used on slippery walks in winter as provided in § 259-6.
No person shall place or split any firewood on any sidewalk, crosswalk or public place or permit or suffer any such wood, chips or similar rubbish to be or remain on any sidewalk, crosswalk, street or road in front of his or her premises.
No person shall sweep, brush, throw or deposit the sweepings of any store or building, or other similar rubbish, upon any sidewalk or street or whip, beat or shake any rug, mat, or carpet in or upon any sidewalk, street or traveled road.
No person shall place, allow to be placed or permit to run, fall or drip the contents of, or any substance from, any sink, privy or cesspool, or any manure, dirt or any foul liquid or obnoxious substance whatsoever, into or upon any street, gutter, sidewalk or public place within the City or allow the same or any part thereof to remain in such place.
The owner or occupant of any lot or parcel of land fronting or abutting on any street, public highway, lane or alley shall keep the sidewalk and the gutter along the same in front of such lot or parcel of land free from ice, dirt, filth, weeds, papers, leaves, obstructions, or encumbrances of every kind and in such manner as to permit easy, safe and commodious use of such sidewalk and to allow the free passage of water in the gutter. Every such owner or occupant shall, after every fall of snow, cause the same to be removed from such sidewalk in order to provide a reasonable, safe and convenient passage for pedestrians.
A. 
Prohibited. No person shall place, put, dump, deposit, or leave any ashes, rubbish, stones, garbage, refuse, shopping carts, tires or material or thing of any kind in the Owasco River, or outlet, or in any raceway or basin connected therewith or forming a part of such river in the City, or permit or allow any such matter or thing to fall into or be so placed, put, deposited or dumped as to slide or fall into said river, raceway or basin, or deposit, place, leave or put any such matter or thing on the bank or shore of such river, raceway or basin.
B. 
Exception. A fill or deposit of earth and stones may be permitted by resolution of the Council upon the erection of a suitable guard, protection or retaining wall so as not to interfere with the flow of the river or the area of any backflow or basin or any raceway.
C. 
Construction or near Owasco River. No person shall place, construct or erect any abutment, wall, foundation or building within, over or upon the banks of any such river, raceway or basin, unless such construction is expressly approved and sanctioned by resolution of the Council. [Note: Permission of New York State Department of Environmental Conservation and United States Army Corps of Engineers may also be required.]

A. 
When snow or ice is removed from private property, it shall not be deposited upon any sidewalk, right-of-way or public street.
B. 
Snow or ice shall not be deposited in a manner that interferes with any fire hydrant or public transportation system.
C. 
Snow or ice shall not be pushed across any public street.
D. 
Snow or ice shall not be deposited upon any public right-of-way designated for handicap accessibility.
E. 
No person or private entity shall plow, shovel, sweep or heap upon any snow, ice or other materials into piles on any public street or public place in the City of Auburn, or cause any such act to be done which interferes with the visibility, safety and convenience with public travel.
F. 
Any person violating the provisions of this section shall be punishable by a fine of not less than $25 and not more than $100.
