City forces or any contractor performing work in the streets of the
City of Batavia under contract with the City may install lateral water and
sewer connections from water and sewer mains in City streets to property lines
without obtaining plumbing permits so long as said work is under the design
and inspection of the City Engineer or his or her representative.
In addition to the powers granted by law, upon the formal written request
by the Manager, he or she shall have the authority to inspect plumbing work
in any building within the city, whether or not a permit has been issued,
in the interest of public safety and public health.
It shall constitute an offense punishable as provided in §
51-45 for any person found to be violating any provision of this article, or the rules and regulations of the Examining Board of Plumbers, or the plumbing standards of the State Uniform Fire Prevention and Building Code and any succeeding code.
A. Service of notice. Any such person in violation shall
be served by the City with written notice stating the nature of the violation
and providing a time limit, as hereinafter set forth, for the satisfactory
correction thereof. The offender shall, within the period of time stated in
such notice, permanently cease all violations.
(1) Plumber. A licensed plumber, being a person holding a
certificate of competency from the Examining Board of Plumbers, shall be given
a three-day notice, as set forth by law.
(2) Other person. Any other person shall be given a ten-day
notice to correct the violation and permanently cease violation.
B. Owner's responsibility. Where notice, as hereinabove
provided, is given to a licensed plumber, a copy of such notice shall be given
to the owner of the premises, or person occupying the premises. If the violation,
as set forth in the notice, is not corrected within 10 days therefrom, the
owner of the premises shall be in violation. Proof of ownership of the premises
during the period of time in which the violation takes place is presumptive
evidence of knowledge and consent by the owner to the commission of acts constituting
the violation.
The penalties set forth in §
51-45 of this chapter shall govern in all instances. In addition thereto, any certificate of competency or license issued to a plumber by the Examining Board of Plumbers may be suspended or revoked for violations of the provisions of this article, the rules and regulations of the Examining Board of Plumbers or the plumbing standards of the State Uniform Fire Prevention and Building Code.
